ACT No. 87 Regular Session, 2010 HOUSE BILL NO. 70 BY REPRESENTATIVE GEYMANN AN ACT1 To enact Subpart B-4-A of Part IV of Chapter 1 of Title 33 of the Louisiana Revised2 Statutes of 1950, to be comprised of R.S. 33:130.81 through 130.83, relative to the3 Wards 4 and 6 Economic Development Board in Beauregard Parish; to establish the4 board; to provide for appointment of members to the board; to provide the powers5 and duties of the board; and to provide for related matters.6 Notice of intention to introduce this Act has been published7 as provided by Article III, Section 13 of the Constitution of8 Louisiana.9 Be it enacted by the Legislature of Louisiana:10 Section 1. Subpart B-4-A of Part IV of Chapter 1 of Title 33 of the Louisiana11 Revised Statutes of 1950, comprised of R.S. 33:130.81 through 130.83, is hereby enacted12 to read as follows: 13 SUBPART B-4-A. WARDS 4 AND 6 ECONOMI C DEVELOPMENT BOARD OF14 BEAUREGARD PARISH15 §130.81. Wards 4 and 6 Economic Development Board of Beauregard Parish;16 creation; purpose17 The Wards 4 and 6 Economic Development Board of Beauregard Parish is18 hereby created. The primary purpose of the board shall be to promote, encourage,19 and participate in economic development activities for wards 4 and 6 of Beauregard20 Parish. These activities include but shall not be limited to endeavors that will21 accomplish or enhance the opportunity for any of the following:22 (1) Growth, development, and prosperity of the wards 4 and 6 area.23 (2) Development of existing commercial structures.24 ENROLLEDHB NO. 70 Page 2 of 4 CODING: Words in struck through type are deletions from existing law; words underscored are additions. (3) Development of underutilized resources.1 (4) Development of the tax base.2 (5) Coordination of public and private programs.3 §130.82. Composition of the board4 A. The Wards 4 and 6 Economic Development Board of Beauregard Parish5 shall be composed of members selected as follows:6 (1) One member shall be appointed by the Louisiana state senator or senators7 who represent any part of ward 4 or 6 of Beauregard Parish.8 (2) Two members shall be appointed by the Louisiana state representative9 or representatives who represent any part of ward 4 or 6 of Beauregard Parish.10 (3) One member shall be appointed by the Beauregard Parish School Board11 member or members who represent any part of ward 4 or 6 of Beauregard Parish.12 (4) Three members shall be appointed by the member or members of the13 governing authority of Beauregard Parish who represent any part of ward 4 or 6 of14 Beauregard Parish.15 B.(1) Members shall serve four-year terms after initial terms as provided in16 Paragraph (2) of this Subsection.17 (2) One member shall serve an initial term of one year; two shall serve an18 initial term of two years; two shall serve an initial term of three years; and two shall19 serve initial terms of four years. The initial terms of the respective members shall20 be determined by lot at the first meeting of the board.21 C. Members shall serve without compensation.22 D. Any vacancy in the membership of the board shall be filled in the manner23 of the original appointment. In the event that the entity responsible for the24 appointment of a member fails to fill a vacancy within thirty days, the remaining25 members of the board shall appoint an interim successor to serve until the position26 is filled by the appointing entity.27 E. Any member so removed shall have the right to appeal his removal to a1 court of competent jurisdiction within ten days of the decision ordering his removal.2 F. Members shall be eligible for reappointment, unless they have been3 removed from office in the manner provided in this Section.4 §130.83. Powers and functions of the board5 The board shall have the following powers and functions:6 (1) Make recommendations and provide relevant information about the7 wards 4 and 6 area concerning such matters as:8 (a) Natural and environmental conditions, trends of industrial population,9 developments, and the culture of the people.10 (b) Land use in the area.11 (c) The need for and the proposed general locations of commercial, mixed12 use, public, or private works and facilities in the area.13 (2) Make or assist in studies of the resources of the wards 4 and 6 area and14 the problems affecting the development of the area and make such studies available15 to the public. In making such studies, the board may seek assistance from public or16 private sources.17 (3) Prepare, maintain, and make available listings of the resources of the18 wards 4 and 6 area and of the major public and private works which affect the19 development of the area.20 (4) Provide information in order to foster public awareness and21 understanding of the purpose of the board and to stimulate public interest and22 participation in the development of the area.23 (5) Accept the donation of public or private grants and services.24 (6) Solicit the assistance of industry and private civic organizations in the25 control and reduction of litter in the area and encourage participation in the "adopt-a-26 road" program as provided in R.S. 48:235 for the purpose of controlling litter along27 the highways of the area.28 (7) Hold public hearings and sponsor public forums.29 ENROLLEDHB NO. 70 Page 4 of 4 CODING: Words in struck through type are deletions from existing law; words underscored are additions.
