MALPRACTICE/MEDICAL:  Provides relative to medical review panels
AN ACT1
To amend and reenact R.S. 40:1299.39.1(A)(1)(c) and 1299.47(A)(1)(c) and (g), relative to2
medical review panels; to provide for an increase in the filing fee for medical review3
panels; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 40:1299.39.1(A)(1)(c) and 1299.47(A)(1)(c) and (g) are hereby6
amended and reenacted to read as follows: 7
§1299.39.1.  State medical review panel8

(c) A claimant shall have forty-five days from the date of the mailing of the11
confirmation of receipt of the request for review in accordance with Subparagraph12
(3)(a) of this Subsection to pay to the commissioner a filing fee in the amount of one13
five hundred dollars per named defendant state health care provider.14

(3)(a) of this Subsection to pay to the board a filing fee in the amount of one five1
hundred dollars per named defendant qualified under this Part.2

(g) The filing fee of one hundred dollars per named defendant qualified4
under this Part shall be applicable in the event that a claimant identifies additional5
qualified health care providers as defendants. The filing fee applicable to each6
identified qualified health care provider shall be due forty-five days from the mailing7
date of the confirmation of receipt of the request for review for the additional named8
defendants in accordance with R.S. 40:1299.47(A)(3)(a) Subparagraph(A)(3)(a) of9
this Section.10

Abstract: Increases the filing fee for a medical review panel from $100 per named
defendant to $500 per named defendant
Present law provides that medical malpractice claims against health care providers shall be
reviewed by a medical review panel, and provides the requirements and procedures for filing
a claim to be reviewed by the panel, including a filing fee of $100 per named defendant.
Proposed law retains present law but increases the filing fee for a medical review panel from
$100 per named defendant to $500 per named defendant.
