WATER/DRINKING WATER:  Provides relative to operators of water systems
AN ACT1
To amend and reenact R.S. 40:1149(B), relative to the operation of certain water systems;2
to provide for the presence of certified operators while certain systems are in3
operation; to provide for rules and regulations; to provide for exceptions; and to4
provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 40:1149(B)  is hereby amended and reenacted to read as follows:7
ยง1149.  Certified operator required; exceptions8

B.(1) Surface water systems shall have a certified operator present at all10
times while the treatment facility is in operation.11
(2) Any rule or regulation adopted to implement this Subsection shall12
provide that the requirement of the presence of a certified operator may be satisfied13
with a person holding a Class I Certified Water System Operator Certificate or better14
with an automated operation system as described in Subsection C of this Section.15
(3) The requirements of this Subsection shall not apply in any parish for16
which a governor declared emergency or disaster has been declared for a period of17
three years from the declaration,18

Abstract: Allows a Class I certified operator with an automated system to fulfill the
requirements of the presence of a certified operator for certain water systems and
suspends the requirement for three years for a parish for which an emergency or
disaster has been declared by the governor.
Present law requires that water systems be operated by operators certified as such by the
state health officer.
Present law requires all surface water systems to have a certified operator present while the
facility is in operation.
Present law provides for an exception to the required presence of a certified operator
requirement for any system that serves fewer than 10,000 persons and utilizes an automated
operation system that allows for remote control and shut down.
Proposed law allows a Class I certified operator with a system that utilizes an automated
operation system that allows for remote control and shut down to fulfill the requirements of
the presence of a certified operator in present law.
Proposed law suspends the requirement for three years in a parish for which an emergency
or disaster has been declared by the governor.
