Regular Session, 2010 HOUSE BILL NO. 725 BY REPRESENTATIVE HUTTER WATER/DRINKING WATER: Provides relative to operators of water systems AN ACT1 To amend and reenact R.S. 40:1149(B), relative to the operation of certain water systems;2 to provide for the presence of certified operators while certain systems are in3 operation; to provide for rules and regulations; to provide for exceptions; and to4 provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 40:1149(B) is hereby amended and reenacted to read as follows:7 ยง1149. [R.S. 1:13(B) and 24:177(E)] Hutter HB No. 725 Abstract: Allows a Class I certified operator with an automated system to fulfill the requirements of the presence of a certified operator for certain water systems and suspends the requirement for three years for a parish for which an emergency or disaster has been declared by the governor. Present law requires that water systems be operated by operators certified as such by the state health officer. Present law requires all surface water systems to have a certified operator present while the facility is in operation. Present law provides for an exception to the required presence of a certified operator requirement for any system that serves fewer than 10,000 persons and utilizes an automated operation system that allows for remote control and shut down. Proposed law allows a Class I certified operator with a system that utilizes an automated operation system that allows for remote control and shut down to fulfill the requirements of the presence of a certified operator in present law. Proposed law suspends the requirement for three years in a parish for which an emergency or disaster has been declared by the governor. (Amends R.S. 40:1149(B))
