CIVIL SERVICE/FIRE & POL: Provides relative to the establishment and maintenance of
promotional employment lists for the classified police service
AN ACT1
To amend and reenact R.S. 33:2491(F) and R.S. 33:2551(6), relative to municipal fire and2
police civil service; to provide relative to the establishment and maintenance of3
promotional employment lists for the various classes of positions in the classified4
police service; to provide relative to the period of time a name may remain on any5
such list; to provide for implementation; and to provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1. R.S. 33:2491(F) and R.S. 33:2551(6) are hereby amended and reenacted8
to read as follows: 9
§2491.  Establishment and maintenance of employment lists10

The board shall establish and maintain employment lists containing names12
of persons eligible for appointment to the various classes of positions in the13
classified service, as follows:14

F. The minimum and maximum period for which a name may remain upon16
a promotional and a competitive employment list shall be twelve and eighteen17
months, respectively, for each list.18
(1)(a) The maximum period of time for which a name may remain upon a19

police civil service board for any of the various classes of positions in the classified1
fire service shall be eighteen months.2
(b) The maximum period of time for which a name may remain upon a3
promotional employment list established and maintained by a municipal fire and4
police civil service board for any of the various classes of positions in the classified5
police service shall be forty-eight months; however, a name on such list prior to the6
effective date of this Paragraph shall not remain on the list for longer than eighteen7
months.8
(2) The maximum period of time for which a name may remain upon a9
competitive employment list established and maintained by a municipal fire and10
police civil service board for any of the various classes of positions in the classified11
service shall be eighteen months.12
(3) The minimum period of time for which a name may remain upon a13
promotional  and a competitive employment list established and maintained by a14
municipal fire and police civil service board for any of the various classes of15
positions in the classified service shall be twelve months.16

§2551.  Establishment and maintenance of employment lists18
The board shall establish and maintain lists containing names of persons19
eligible for appointment to the various classes of positions in the classified service,20
as follows:21

(6)  The minimum and maximum period for which a name may remain upon23
a promotional and competitive employment list shall be twelve and eighteen months,24
respectively, for each list.25
(a)(i) The maximum period of time for which a name may remain upon a26
promotional employment list established and maintained by a municipal fire and27
police civil service board for any of the various classes of positions in the classified28

(ii) The maximum period of time for which a name may remain upon a1
promotional employment list established and maintained by a municipal fire and2
police civil service board for any of the various classes of positions in the classified3
police service shall be forty-eight months; however, a name on such list prior to the4
effective date of this Subparagraph shall not remain on the list for longer than5
eighteen months.6
(b) The maximum period of time for which a name may remain upon a7
competitive employment list established and maintained by a municipal fire and8
police civil service board for any of the various classes of positions in the classified9
service shall be eighteen months.10
(c) The minimum period of time for which a name may remain upon a11
promotional  and a competitive employment list established and maintained by a12
municipal fire and police civil service board for any of the various classes of13
positions in the classified service shall be twelve months.14

Section 2. The provisions of R.S. 33:2491(F)(2) shall not affect promotional16
employment lists established and maintained by the municipal fire and police civil service17
board of the city of West Monroe pursuant to R.S. 33:2491.4, which was enacted by Act No.18
329 of the 2009 Regular Session of the Legislature.  The municipal fire and police civil19
service board of the city shall continue to maintain any such list and shall continue to operate20
under the provisions of R.S. 33:2491.4.21
Section 3.  This Act shall become effective on September 1, 2010.22

Present constitution creates a fire and police civil service system applicable to municipalities
of over 13,000 in population and parishes and fire protection districts.  Provides that the
system is subject to Art. XIV, §15.1 of the 1921 Constitution made statutory by the 1974
Constitution.  Present law creates and provides for two fire and police civil service systems:
(1) one applicable to any municipality which operates paid police and fire departments and
which has a population of not fewer than 13,000 persons; and (2) one applicable to any
parish, fire protection district, or municipality with a population of fewer than 13,000, but
not fewer than 7,000 persons.  Present constitution authorizes modifications to such systems
(by law adopted by a 2/3 vote of each house of the legislature in the case of provisions of
Art. XIV, §15.1 of the 1921 Constitution made statutory by the Constitution of 1974) but
prohibits the legislature from abolishing the system or making it inapplicable to covered
jurisdictions.
Proposed law retains present constitution and present law.
Present law, relative to both systems, provides that a municipal fire and police civil service
board is created in the municipal government. Requires the board to establish and maintain
employment lists containing the names of persons eligible for appointment to various classes
of positions in the classified service. Requires the board, through the state examiner, to
provide for tests to determine the eligibility of applicants for entry upon promotional and
competitive employment lists. Provides that the minimum period for which a name may
remain upon a promotional and a competitive employment list for the classified fire and
police service is 12 months. Provides that promotional tests for positions in the various
classes in the classified fire and police service, except those classes in which positions shall
be filled only from the competitive list, may be held as the needs of the service require, but
must be given at least one time during each successive period of 18 months. Proposed law
retains present law.
Present law provides that the maximum period for which a name may remain upon a
competitive employment list for the classified fire and police service is 18 months.  Proposed
law retains present law.
Present law provides that the maximum period for which a name may remain on a
promotional employment list for the classified fire and police service is 18 months but
provides an exception for the classified police service in the city of West Monroe.  Present
law ( R.S. 33:2491.4) provides that the maximum period for which a name may remain on
a promotional list for the classified police service in the city of West Monroe is 48 months.
Proposed law retains present law provisions that provide a maximum period of 18 months
for the classified fire service but extends the maximum period of time for which a name may
remain upon a promotional employment list for the classified police service from 18 to 48
months. Provides however, that a name on such list prior to the effective date of the Act
shall not remain on the list for longer than 18 months.
Provides that provisions of the Act shall not affect promotional employment lists by the
board in the city of West Monroe pursuant to present law (R.S. 33:2491.4). Provides that
the board of the city shall continue to maintain such lists and shall continue to operate under
the provisions of present law (R.S. 33:2491.4).
Effective Sept. 1, 2010.
