Regular Session, 2010 HOUSE BILL NO. 817 BY REPRESENTATIVE WILLIAMS EMPLOYMENT: Provides relative to credit information for employment purposes AN ACT1 To enact Part VIII of Chapter 3-A of Title 23 of the Louisiana Revised Statutes of 1950, to2 be comprised of R.S. 23:371, relative to employment practices; to provide that no3 employer, labor organization, or employment agency shall refuse to hire, bar, or4 discharge an individual from employment because of the individual's credit history;5 and to provide for related matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. Part VIII of Chapter 3-A of Title 23 of the Louisiana Revised Statutes of8 1950, comprised of R.S. 23:371, is hereby enacted to read as follows:9 PART VIII. EMPLOYMENT PRACTICES10 ยง371. Disclosure of credit reports and credit history11 It shall be unlawful discrimination in employment for an employer, labor12 organization, or employment agency to fail or refuse to hire, bar, discharge from13 employment, or otherwise discriminate against an applicant or employee because of14 the applicant or employee's credit history or credit report unless the information in15 the credit history or credit report directly relates to a bona fide occupation16 qualification reasonably necessary to the normal operation of that business or17 enterprise.18 HLS 10RS-1473 ORIGINAL HB NO. 817 Page 2 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. Proposed law provides that an employer, labor organization, or employment agency shall not fail or refuse to hire, bar, discharge from employment, or otherwise discriminate against an applicant or employee because of information contained in the applicant or employee's credit history or credit report unless the information directly relates to a bona fide occupation qualification reasonably necessary to the normal operation of that business or enterprise.
