Regular Session, 2010 HOUSE BILL NO. 859 BY REPRESENTATIVES ARNOLD AND GISCLAIR TRAFFIC/VIOLATIONS: Prohibits certain traffic cameras on highways that receive public funding AN ACT1 To enact R.S. 32:239, relative to traffic violations; to prohibit installing or using automated2 recording equipment or system to enforce compliance with any traffic law on state3 highways or local roads that receive federal or state funding; defines the term4 "automated recording equipment system"; and to provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 32:239 is hereby enacted to read as follows:7 ยง239. Automated traffic photo enforcement system; prohibition8 A. Local municipal authorities or local parish authorities shall not install or9 use automated traffic enforcement systems to enforce compliance with traffic laws,10 ordinances, rules, or regulations on any local street, road, or state highway within its11 jurisdiction, when the local municipality or parish receives federal or state funding12 for said local street, road, or state highway.13 B. For the purposes of this Section, the term "automated traffic enforcement14 system" means a camera or optical device installed to work in conjunction with a15 traffic control signal or radar speed detection equipment, or both, and designed to16 record images that depict the license plate or other identifying feature of a motor17 vehicle that is not operated in compliance with instruction of a traffic control signal18 or a posted traffic sign.19 HLS 10RS-450 ORIGINAL HB NO. 859 Page 2 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. Proposed law defines the term "automated traffic enforcement system" as a camera or optical device installed to work in conjunction with a traffic control signal or radar speed detection equipment or both and designed to record images that depict the license plate or other identifying feature of a motor vehicle that is not operated in compliance with instruction of a traffic control signal or a posted traffic sign. Proposed law requires local municipal authorities or local parish authorities currently using automated traffic enforcement systems in violation of proposed law to discontinue such use by Jan. 1, 2011.
