GERMAIN AND SENATOR CHAISSON WILDLIFE/FEES: Authorizes the Wildlife and Fisheries Commission to biennially adjust fees in accordance with the Consumer Price Index AN ACT1 To enact R.S. 34:852.21(C) and R.S. 56:6.3 and to repeal R.S. 56:6(28), relative to the2 powers of the Wildlife and Fisheries Commission; to authorize the commission to3 biennially adjust, in accordance with the consumer price index, fees charged by the4 Department of Wildlife and Fisheries; to require biennial promulgation of a fee5 schedule for all fees charged by the department; and to provide for related matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. R.S. 34:852.21(C) is hereby enacted to read as follows:8 §852.21. Fees9 * * *10 C. The Wildlife and Fisheries Commission shall have the authority to adjust11 fees which are assessed, charged, and collected by the Department of Wildlife and12 Fisheries. Such adjustments may be made biennially to fees to be charged in odd-13 numbered years and shall be in an amount not to exceed the annual percentage14 change in the Consumer Price Index for All Urban Consumers (CPI-U)(All Items -15 United States City Average) maintained by the United States Department of Labor,16 Bureau of Labor Standards, rounded downward to the nearest dime. Any such17 adjustment to a fee which has already been adjusted under the provisions of this18 Subsection shall be calculated on the percentage change from the latest adjustment19 of that fee. No fee shall be adjusted by an amount in total which is in excess of fifty20 percent of the fee amount which was enacted by the legislature. Such promulgated fee schedule shall contain the amount for every1 fee charged by the department whether or not such fee has been adjusted under the2 provisions of this Subsection.3 Section 2. R.S. 56:6.3 is hereby enacted to read as follows:4 §6.3. Powers of the commission; adjustment to fees5 The Wildlife and Fisheries Commission shall have the authority to adjust fees6 which are assessed, charged, and collected by the Department of Wildlife and7 Fisheries. Such adjustments may be made biennially to fees to be charged in odd-8 numbered years and shall be in an amount not to exceed the annual percentage9 change in the Consumer Price Index for All Urban Consumers (CPI-U)(All Items -10 United States City Average) maintained by the United States Department of Labor,11 Bureau of Labor Standards, rounded downward to the nearest dime. Such promulgated fee schedule shall contain the19 amount for every fee charged by the department whether or not such fee has been20 adjusted under the provisions of this Section.21 Section 3. Provides that no fee can be adjusted by an amount in total which is in excess of 50% of the fee amount enacted by the legislature. Requires the commission to promulgate a fee schedule for implementation on Nov. 15 of each even-numbered year which shall be applicable to fees to be charged for activities during the upcoming license year. Requires that the fee schedule contain the fee charged by the department whether or not such fee has been adjusted by the commission. Present law authorizes the commission to impose fees for nonresident hunting and fishing licenses. Proposed law repeals this authorization.
