FISHING/OYSTERS: Authorizes the Wildlife and Fisheries Commission to promulgate
rules to protect oyster habitat from harvest-related damage
AN ACT1
To amend and reenact R.S. 56:433(I), relative to public oyster seed grounds; to authorize the2
Wildlife and Fisheries Commission to promulgate rules to protect the natural reefs3
from harvest-related damage and destruction; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 56:433(I) is hereby amended and reenacted to read as follows:6
ยง433. Culling oysters taken from natural reefs; size limits7

I. The commission shall designate the natural reefs by regulation. The9
commission shall have the authority to protect oyster habitat on the natural reefs,10
public oyster seed grounds, and public oyster seed reservations from oyster-harvest-11
related activities. The commission may monitor the removal of non-living reef12
material from the natural reefs, the public oyster seed grounds, and seed reservations13
and may promulgate rules and regulations which limit the removal of such reef14
material and may enforce such limitations, including penalizing the removal of15
excessive amounts of such reef material. In addition, the commission may16
promulgate rules and regulations which protect the natural reefs, the public oyster17
seed grounds, and seed reservations from harvest practices which have been18
determined to cause damage or destruction to oyster habitat in those areas.19 HLS 10RS-381 ORIGINAL

Proposed law gives the Wildlife and Fisheries Commission authority to protect oyster habitat
on the natural reefs, public oyster seed grounds, and public oyster seed reservations from
oyster-harvest-related activities. Authorizes the commission to monitor removal of non-
living reef material, to promulgate regulations which limit removal of such reef material, and
to enforce such limitations.
