AN ACT1
To amend and reenact R.S. 30:2344(D), to enact R.S. 30:2344(E) and (F), and to repeal R.S.2
30:2345, relative to asbestos abatement in schools; to provide for asbestos3
abatement; to provide for the methods of abatement; to repeal the Louisiana School4
Asbestos Abatement Commission; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 30:2344(D) is hereby amended and reenacted and R.S. 30:2344(E)7
and (F) are hereby enacted to read as follows:8

D. Abatement activities shall be commenced as soon as rules and regulations11
concerning abatement are approved by the commission provided for by this Chapter,12
and finalized promulgated by the Department of Environmental Quality, in13
accordance with the Administrative Procedure Act.14
E. The building owner shall select the method of abatement to be used from15
those set forth in R.S. 30:2343(1) or as provided in the rules and regulations adopted16
pursuant to this Chapter. Any method selected must be used in the manner that such17
rules and regulations require.18
F. No school, which has commenced abatement work at a particular site19
prior to the effective date of regulations or standards adopted or imposed pursuant20
to this Chapter, shall be required to conduct a different type of abatement at the same21
site unless levels of airborne asbestos fibers exceed an abatement action level22 ENROLLEDHB NO. 895

established by the regulations adopted pursuant to this Chapter which are applicable1
to all school buildings.2
Section 2. R.S. 30:2345 is hereby repealed in its entirety.3
