MTR VEHICLE/INSPECTION: Increases motor vehicle inspection fees in East Baton
Rouge Parish
AN ACT1
To amend and reenact R.S. 32:1306(C)(2) and (5) and 1309 and to enact R.S. 32:1315,2
relative to motor vehicle inspections; to authorize East Baton Rouge Parish to collect3
fees for motor vehicle inspections; and to provide for related matters.4
Notice of intention to introduce this Act has been published5
as provided by Article III, Section 13 of the Constitution of6
Louisiana.7
Be it enacted by the Legislature of Louisiana:8
Section 1. R.S. 32:1306(C)(2) and (5) and 1309 are hereby amended and reenacted9
and R.S. 32:1315 is hereby enacted to read as follows:10
§1306.  Operation of official inspection stations11

(2) Except as otherwise provided in this Subsection and in East Baton Rouge15
Parish, an annual charge or fee of ten dollars shall be charged for each certificate of16
inspection and approval issued, four dollars and seventy-five cents of which shall be17
retained by the operator of the motor vehicle inspection station conducting the18

use in traffic law enforcement, and one dollar and twenty-five cents shall be1
transferred to the office of motor vehicles for expenses associated with the motor2
vehicle inspection and financial responsibility programs. Included in the inspection3
shall be the adjustment of headlights when needed and mechanically practical, at no4
additional cost to the operator of the motor vehicle inspected.5

(5) An annual charge or fee of thirty dollars shall be charged for the7
inspection of all commercial motor vehicles which are required to be inspected under8
the provisions of Part 396 of Title 49 of the Code of Federal Regulations, including9
Part 396.17 and "Appendix G" thereof. Except in East Baton Rouge Parish, no No10
charges or fees other than the thirty-dollar fee shall be charged for a commercial11
motor vehicle inspection.  Of the thirty-dollar fee, the motor vehicle inspection12
station operator who performs this inspection shall retain twenty-three dollars and13
seventy-five cents; two dollars and twenty-five cents shall be transferred to the office14
of motor vehicles for expenses associated with motor vehicle and financial15
responsibility programs; and four dollars of which shall be transferred to the office16
of state police for use in traffic law enforcement. Included in the inspection shall be17
the adjustment of headlights at no additional cost to the operator of the motor vehicle18
being inspected. The Legislature of Louisiana hereby declares that a commercial19
motor vehicle inspection is much more extensive than the inspection mandated in20
Paragraph (2) of this Subsection and that the increase in the fee or charge for the21
inspection of commercial vehicles is based on the difference in the two types of22
inspection.23

§1309.  Fee for inspection certificates25
The fees collected for the issuance of certificates of inspection and approval26
shall be deposited in the state treasury upon receipt and shall be credited to the Bond27
Security and Redemption Fund as required by Article VII, Section 9 of the28 HLS 10RS-1164	ORIGINAL

Constitution of Louisiana. The provisions of this Section shall not apply to fees1
collected pursuant to R.S. 32:1315.2

§1315.  East Baton Rouge Parish; fees and charges4
A. The governing authority of East Baton Rouge Parish shall collect the5
following fees or charges for motor vehicle inspections conducted in East Baton6
Rouge Parish:7
(1) An annual charge or fee of seven dollars shall be charged for each8
certificate of inspection and approval issued.9
(2) An annual charge or fee of ten dollars shall be charged for the  inspection10
of all commercial motor vehicles which are required to be inspected under the11
provisions of Part 396 of Title 49 of the Code of Federal Regulations, including Part12
396.17 and "Appendix G" thereof.13
B. All fees or charges collected  by the governing authority of East Baton14
Rouge Parish shall be utilized as part of the parish's financial contribution as defined15
by R.S. 48:1453(2) and for other mass transit purposes.16

Abstract: Increases motor vehicle inspection fees in East Baton Rouge Parish and directs
funds to be used for mass transit purposes.
Present law provides that motor vehicle inspections fees, absent emission inspection fees,
in East Baton Rouge Parish are $10 for motor vehicles and $30 for commercial motor
vehicles.
Proposed law provides that motor vehicle inspection fees, absent emission inspection fees,
in East Baton Rouge Parish shall be $17 for motor vehicles and $40 for commercial motor
vehicles.
Present law provides that the motor vehicle inspection fees, absent emission inspection fees,
are divided between the station operator, the office of motor vehicles, and office of state
police.
