INSURANCE/AUTOMOBILE:  Prohibits a policyholder under a motor vehicle liability
policy from permitting any person excluded from coverage to drive the covered
vehicle
AN ACT1
To enact R.S. 22:1923(1)(j) and R.S. 32:900.1, relative to motor vehicle liability policies;2
to provide for definitions; to provide that permitting an excluded person to drive a3
covered vehicle constitutes a fraudulent insurance act; to prohibit a policyholder4
from permitting any person excluded from coverage under the policyholder's motor5
vehicle liability policy from operating the covered vehicle absent certain6
circumstances; and to provide for related matters.7
Be it enacted by the Legislature of Louisiana:8
Section 1. R.S. 22:1923(1)(j) is hereby enacted to read as follows: 9
§1923.  Definitions10
As used in this Part the following terms shall have the meanings indicated11
herein:12
(1) "Fraudulent insurance act" shall include but not be limited to acts or13
omissions committed by any person who, knowingly and with intent to defraud:14

(j) Permits a person excluded from coverage under a motor vehicle liability16
insurance policy to operate the policyholder's motor vehicle, unless the excluded17
person is otherwise covered by an applicable motor vehicle insurance policy.18

 Section 2. R.S. 32:900.1 is hereby enacted to read as follows:1
§32:900.1.  Permission given to excluded persons2
No policyholder insured under a motor vehicle liability policy shall expressly3
or implicitly permit any person excluded from coverage under that policy to operate4
the covered motor vehicle, unless the excluded person is otherwise covered by an5
applicable motor vehicle insurance policy. 6
Section 3.  The provisions of this Act shall become effective on January 1, 2011.7

Abstract: Prohibits a policyholder under motor vehicle insurance policy to permit any
person excluded from coverage to drive the covered vehicle.
Proposed law provides that the act of a policyholder permitting any person excluded from
coverage to drive a vehicle covered under this motor vehicle liability policy constitutes a
fraudulent insurance act.  
Proposed law prohibits any policyholder under a motor vehicle liability policy from
expressly or implicitly allowing an excluded person to operate the covered vehicle, unless
the excluded person is otherwise covered by an applicable motor vehicle insurance policy.
Effective Jan. 1, 2011.
