STUDENT/HOME STUDY: Provides relative to immunization against meningococcal
disease
AN ACT1
To amend and reenact R.S. 17:170.4(C)(2) and to repeal R.S. 17:170.4(A)(1)(c), relative to2
immunizations; to remove the requirement that certain students in certain home study3
programs provide documentation of immunization against meningococcal disease;4
and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 17:170.4(C)(2) is hereby amended and reenacted to read as follows:7

(2) The secretary of the Department of Health and Hospitals shall provide13
such rules, including the implementation schedule, to the state Department of14
Education by not later than August 1, 2009. The state Department of Education shall15
notify each city, parish, or other local school board,  and the governing authority of16
each nonpublic school system or school in the case of a school not a part of a school17
system, and the parent or legal guardian of any student participating in an approved18
home study program as specified in Subparagraph (A)(1)(c) of this Section of the19 HLS 10RS-1576	ORIGINAL

requirements of this Section and the rules and schedule for their implementation as1
provided by this Section.2

Section 2.  R.S. 17:170.4(A)(1)(c) is hereby repealed in its entirety. 4

Abstract: Removes requirement that certain students in approved home study programs
provide evidence of current immunization against meningococcal disease.
Present law requires 11-year-old students in approved home study programs to provide
evidence of current immunization against meningococcal disease to BESE and requires the
state Dept. of Ed. to notify such students' parents or legal guardians of such requirement.
Proposed law removes present law.
(Amends R.S. 17:170.4(C)(2); Repeals R.S. 17:170.4(A)(1)(c))
