GERMAIN ENERGY/PIPELINES: Provides for pipelines transporting hydrogen AN ACT1 To enact R.S. 19:2(13) and R.S. 30:4(C)(18), relative to the transportation of hydrogen; to2 provide for the expropriation of property; to provide for authority of the3 commissioner of conservation; to provide for the issuance of certificates of public4 necessity; and to provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 19:2(13) is hereby enacted to read as follows:7 §2. Expropriation by state or certain corporations and limited liability companies8 Where a price cannot be agreed upon with the owner, any of the following9 may expropriate needed property:10 * * *11 (13) Any domestic or foreign corporation or any partnership composed of12 such corporations or wholly owned subsidiaries thereof engaged in the piping or13 marketing of hydrogen. Property located in Louisiana may be so expropriated for14 the transportation of hydrogen for projects located in Louisiana or in other states or15 jurisdictions.16 Section 2. R.S. 30:4(C)(18) is hereby enacted to read as follows:17 §4. Jurisdiction, duties, and powers of the assistant secretary; rules and regulations18 * * *19 C. No person shall exercise the right of expropriation under the5 laws of this state in connection with the construction or operation of such a hydrogen6 pipeline unless a certificate of public convenience and necessity for the pipeline has7 been issued. If the project is located in another state or jurisdiction, the8 commissioner's approval shall consist of confirmation that the applicable regulatory9 authority of that state or jurisdiction has approved or authorized such project.10 * * *11 DIGEST The digest printed below was prepared by House Legislative Services. Proposed law authorizes the expropriation of property for hydrogen pipelines upon the issuance of a certificate of public necessity by the commissioner of conservation.
