ENROLLED Page 1 of 2 Regular Session, 2010 HOUSE CONCURRENT RESOLUTI ON NO. 83 BY REPRESENTATIVE HARDY A CONCURRENT RESOLUTI ON To urge and request the House Committee on House and Governmental Affairs and the Senate Committee on Senate and Governmental Affairs to meet and function as a joint committee to study possible strategies, methods, and policies to discourage the mishandling, misuse, and misappropriation of public funds and procedures to recover public funds which may have been mishandled, misused, or misappropriated. WHEREAS, on occasion there are published press reports and audit reports that indicate the mishandling, misuse, or misappropriation of public funds by a public official; and WHEREAS, some of these instances may not warrant criminal prosecution; and WHEREAS, aside from voluntary repayment, there is no distinct method to recover those public funds in many instances; and WHEREAS, any effort to deal with the mishandling, misuse, or misappropriation of public funds by a public official involves complex legal and ethical considerations. THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby urge and request the House Committee on House and Governmental Affairs and the Senate Committee on Senate and Governmental Affairs to meet and function as a joint committee to study possible strategies, methods, and policies to discourage the mishandling, misuse, and misappropriation of public funds and procedures to recover public funds which have been mishandled, misused, or misappropriated. BE IT FURTHER RESOLVED that the joint committee shall specifically solicit input, recommendations, and advice from the following: (1) A representative of the legislative auditor. (2) A representative of the Louisiana District Attorneys Association. (3) A representative of the Board of Ethics. ENROLLEDHCR NO. 83 Page 2 of 2 (4) A representative of the state inspector general. (5) A representative of the attorney general. (6) A representative of the United States Attorney's Office for the Middle District of Louisiana. BE IT FURTHER RESOLVED that the joint committee shall report its findings to the legislature no later than March 1, 2011. BE IT FURTHER RESOLVED that a suitable copy of this Resolution be transmitted to the legislative auditor, the Louisiana District Attorneys Association, the Board of Ethics, the state inspector general, the attorney general, and the United States Attorney's Office for the Middle District of Louisiana.
