HOUSE CONCURRENT STUDY REQUEST NO. 13

WORKERS COMPENSATION: Requests the House and Senate Committees on labor and
industrial relations to study alternative ways of funding the Workers' Compensation
Second Injury Fund
A CONCURRENT STUDY REQUEST1
To the House Committee on Labor and Industrial Relations and the Senate Committee on2
Labor and Industrial Relations to meet and to function as a joint committee to study3
methods for funding the Workers' Compensation Second Injury Fund, and to report4
the findings of the joint committee to the legislature prior to the convening of the5
2011 Regular Session of the Legislature of Louisiana.6
WHEREAS, House Bill No. 1197 of the 2010 Regular Session of the Legislature7
would have provided for certain methods of funding the Second Injury Fund; and 8
WHEREAS, one method of funding provides on June 1st of each year, the Louisiana9
Workforce Commission (the commission) shall determine the total amount needed to pay10
all estimated liabilities, including administrative expenses, of the Second Injury Fund for the11
following fiscal year; and12
WHEREAS, the commission shall assess this amount against self-insured employers13
and insured employers; and 14
WHEREAS, funding methods also provide that the total amount of the assessment15
made by the commission shall be allocated between self-insured employers and insured16
employers based on paid indemnity losses for the preceding calendar year, as provided by17
proposed law; and18
WHEREAS, the method of assessing self-insured employers shall be based on paid19

WHEREAS, methods also provide the commission shall notify and provide the1
amount due to each self-insured employer on or before June 30
th
of each year; and2
WHEREAS, each self-insured employer shall have until August 1
st
of the same3
calender year to pay at least one-half of the amounts due to the commission; and4
WHEREAS, there may be alternative methods of funding the Second Injury Fund.5
THEREFORE, the Legislature of Louisiana requests the House Committee on Labor6
and Industrial Relations and the Senate Committee on Labor and Industrial Relations to meet7
and to function as a joint committee to study methods of funding the Second Injury Fund8
and to report the findings of the joint committee to the legislature prior to the convening of9
the 2011 Regular Session of the Legislature of Louisiana.10
