HLS 10RS-1812 ORIGINAL Page 1 of 2 Regular Session, 2010 HOUSE CONCURRENT STUDY REQUEST NO. 2 BY REPRESENTATIVE LEGER CONTROLLED SUBSTANCES: Requests a study of whether to make specified plants controlled dangerous substances A CONCURRENT STUDY REQUEST1 To the House Committee on the Administration of Criminal Justice and the Senate2 Committee on Judiciary B to meet and to function as a joint committee to study the3 effects of the products referred to as "Spice", "Mojo", "K2", "Skunk", "Sense",4 "Genie", "Yucatan Fire", and various other names and make a determination if5 classifying these compounds as controlled dangerous substances is warranted at this6 time and to report the findings of the joint committee to the legislature prior to the7 convening of the 2011 Regular Session of the Legislature. 8 WHEREAS, there has been a surge of products marketed and sold in Louisiana as9 herbal incense and smoking materials containing various plant products purported to be10 laced with synthetic cannabinoids having hallucinogenic properties which are similar to11 marijuana; and12 WHEREAS, these products are labeled and marketed under the names "Spice",13 "Mojo", "K2", "Skunk", "Sense", "Genie", "Yucatan Fire", and various other names; and14 WHEREAS, the laws of Louisiana provide that in order for a drug to be classified15 as a controlled dangerous substance that the drug or other substance has a high potential for16 abuse, the drug or other substance has no currently accepted medical use in treatment in the17 United States, and there is a lack of accepted safety for use of the drug or other substance18 under medical supervision; and19 WHEREAS, Louisiana law also provides that the secretary of the Department of20 Health and Hospitals shall add a substance as a controlled dangerous substance if it is21 HLS 10RS-1812 ORIGINAL HCSR NO. 2 Page 2 of 2 classified as a controlled dangerous substance by the United States Drug Enforcement1 Administration; and 2 WHEREAS, the secretary may by rule add a drug to the list of controlled dangerous3 substances after conducting an eight-point review of the drug or substance and finding that4 such drug or other substance has a high potential for abuse; and 5 WHEREAS, at this time none of the products referred to as "Spice", "Mojo", "K2",6 "Skunk", "Sense", "Genie", "Yucatan Fire" and various other names have been listed as7 controlled dangerous substances by the United States Drug Enforcement Administration; and8 WHEREAS, additional study of this issue is necessary in order to keep Louisiana law9 consistent with federal law and the laws of the other states.10 THEREFORE, the Legislature of Louisiana requests the House Committee on the11 Administration of Criminal Justice and the Senate Committee on Judiciary B to meet and12 to function as a joint committee to study the effects of the products referred to as "Spice",13 "Mojo", "K2", "Skunk", "Sense", "Genie", "Yucatan Fire", and various other names and14 make a determination if classifying these compounds as controlled dangerous substances is15 warranted at this time and to report the finding of the joint committee to the legislature prior16 to the convening of the 2011 Regular Session of the Legislature. 17 DIGEST The digest printed below was prepared by House Legislative Services.
