HOUSE STUDY REQUEST NO. 10

MTR VEHICLE/TRAILERS:  Requests the House Committee on Transportation, Highways
and Public Works to study the practicality of requiring trailers with a certain gross
weight capacity to be equipped with a  certain type of safety device
A STUDY REQUEST1
To the House Committee on Transportation, Highways and Public Works to meet  and to2
study the practicality of requiring trailers with a certain gross weight capacity to be3
equipped with a certain type of safety device and to report its findings to the House4
of Representatives prior to the convening of the 2011 Regular Session of the5
Legislature of Louisiana.6
WHEREAS, R.S. 32:384(D) requires every trailer and semitrailer with a load7
capacity of up to six thousand pounds be equipped with a safety device; and8
WHEREAS, the current provision of law also requires the safety device to be9
securely attached to the towing vehicle while the trailer or semitrailer is in motion on a10
public road or highway; and11
WHEREAS, the safety device is required to be approved by the Department of Public12
Safety and Corrections, office of state police, making sure it meets all the necessary13
requirements of a safety device; and14
WHEREAS, the House Committee on Transportation, Highways and Public Works15
held hearings during the 2010 Regular Session of the Legislature of Louisiana requiring16
trailers with a gross weight capacity of six thousand pounds to be equipped with a safety17
device, particularly House Bill No.  1479 by Representative Nickie Monica; and18
WHEREAS, the Senate Committee on Transportation, Highways and Public Works19
concluded that it was appropriate and necessary to conduct interim hearings to study the20 HLS 10RS-5635	ORIGINAL

practicality of requiring trailers with a certain gross weight capacity to be equipped with a1
certain type of safety device; and2
WHEREAS, the office of state police  should include in its criteria when making the3
determination of whether or not to approve such safety device that the device should have4
a stamp or a permanent label attached to the safety device and be applicable to the size of5
the load capacity of the trailer.6
THEREFORE, the House of Representatives of the Legislature of Louisiana requests7
the House Committee on Transportation, Highways and Public Works to meet and to study8
the practicality of requiring trailers with a certain gross weight capacity to be equipped with9
a certain type of safety device, and to report its findings to the House of Representatives10
prior to the convening of the 2011 Regular Session of the Legislature of Louisiana.11
BE IT FURTHER RESOL VED that the committee shall solicit input and12
recommendations and advice from the Department of Public Safety and Corrections, office13
of state police, and the Louisiana Motor Transport Association.14
BE IT FURTHER RESOLVED that the committee shall report its findings and15
recommendation to the legislature by January 1, 2011.16
