(8/15/10) AN ACT1 To enact R.S. 41:17, relative to state lands; to provide for certain civil actions involving the2 State Mineral and Energy Board; to require that the office of state lands be joined in3 certain civil actions; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 41:17 is hereby enacted to read as follows: 6 ยง17. Actions involving State Mineral and Energy Board; parties7 In any civil action in which the State Mineral and Energy Board is a8 party, the Division of Administration, office of state lands shall be joined as a9 party if such action involves: (a) determining the ownership of any lands10 belonging to the state, or the title to which is in the public, including road beds,11 water bottoms, vacant state lands, and lands adjudicated to the state at tax sale,12 or (b) determining the state ownership of minerals, oil, or gas.13 SB NO. 187 SLS 10RS-779 ORIGINAL Page 2 of 2 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. DIGEST Proposed law provides that any civil action in which the State Mineral and Energy Board is a party, the DOA, office of state lands must be joined as a party if such action involves: (a) determining the ownership of any lands belonging to the state, or the title to which is in the public, including road beds, water bottoms, vacant state lands, and lands adjudicated to the state at tax sale, or (b) determining the state ownership of minerals, oil, or gas.
