PUBLIC CONTRACTS. Limits the number of unit prices in lump sum contracts pursuant
to the Public Bid law. (8/15/10)
AN ACT1
To enact R.S. 38:2212(A)(3)(h) relative to public contracts; to provide relative to lump sum2
contracts and unit prices; and to provide for related matters.3
Be it enacted by the Legislature of Louisiana:4
Section 1.  R.S. 38:2212(A)(3)(h) is hereby enacted to read as follows: 5
§2212. Advertisement and letting to lowest responsible bidder; public work;6
electronic bidding; participation in mentor-protégé program;7

(h) Any proposal, which requires a bidder to submit a lump sum cost for11
public work, shall include no more than five unit prices on the bid form. Such12
unit prices shall not be used to determine the low bidder and the contract price.13
Such five unit price limitation shall be in addition to the limitation on alternates14
provided in R.S. 38:2212 (A)(3)(e).15 SB NO. 220

Proposed law provides that any proposal, which requires a bidder to submit a lump sum cost
for public work, shall include no more than five unit prices on the bid form.
Proposed law provides that such unit prices shall not be used to determine the low bidder and
contract price.
Proposed law provides that such five unit price limitation shall be in addition to the
limitation on alternates provided in R.S. 38:2212 A(3)(e).
Effective August 15, 2010.
