Regular Session, 2010 ENROLLED SENATE BILL NO. 34 BY SENATOR MARTINY AND REPRESENTATIVE KATZ AN ACT1 To enact R.S. 37:775(13), relative to the practice of dentistry; to provide for advertisements2 by dentists; to provide for disclosure requirements in advertisements; and to provide3 for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 37:775(13) is hereby enacted to read as follows: 6 ยง775. Unprofessional conduct defined7 As used in this Chapter, "unprofessional conduct" means:8 * * *9 (13) Notwithstanding any provision of this Section, when it is required10 by this Section that an advertisement include the name of the advertising dentist11 as it appears on the license or renewal certificate of the dentist or the specialties12 of all dentists practicing within or under the name of a corporation, company,13 association, limited liability company, or trade name be disclosed in the14 advertisement, such requirement shall be deemed to be sufficiently satisfied if15 the names and specialties of all dentists practicing in, with or under the said16 corporation, company, association, limited liability company, or trade name are17 made available on an Internet web site fully disclosed in the advertisement, or18 are provided without delay to any individual requesting such information by19 contacting the advertiser at a telephone number also disclosed in the20 advertisement. Whether the advertisement is run by the corporation, company,21 association, limited liability company, or trade name, or any individual member22 practicing therein, all dentists practicing in, with or under the corporation,23 company, association, limited liability company, or trade name shall be24 responsible for the content of the advertisement.25 Section 2.
