SENATE BILL NO. 347
BY SENATOR MARIONNEAUX 
TUITION.  Constitutional amendment to exempt state colleges and universities from the
requirement that new fees or increase in existing fees be enacted by a two-thirds vote of the
elected members of each house of the legislature. (CA13s1(A))
A JOINT RESOLUTION1
Proposing to amend Article VII, Section 2.1 of the Constitution of Louisiana, relative to the2
enactment of new fees or civil fines or increases in existing fees or civil fines; to3
exempt new fees or increases in existing fees of state colleges and universities from4
the requirement that they be enacted by a two-thirds vote of the elected members of5
each house of the legislature; and to specify an election for submission of the6
proposition to electors and provide a ballot proposition.7
Section 1. Be it resolved by the Legislature of Louisiana, two-thirds of the members8
elected to each house concurring, that there shall be submitted to the electors of the state, for9
their approval or rejection in the manner provided by law, a proposal to amend Article VII,10
Section 2.1 of the Constitution of Louisiana, to read as follows:11
ยง2.1.  Fees and Civil Fines; Limitation12
Section 2.1.(A) Any new fee or civil fine or increase in an existing fee or13
civil fine imposed or assessed by the state or any board, department, or agency of the14
state shall require the enactment of a law by a two-thirds vote of the elected members15
of each house of the legislature.16
(B) The provisions of this Section shall not apply to 	the following:17 SB NO. 347

(1) Any department which is constitutionally created and headed by an1
officer who is elected by majority vote of the electorate of the state.2
(2) State colleges and universities.3
Section 2.  Be it further resolved that this proposed amendment shall be submitted4
to the electors of the state of Louisiana at the statewide election to be held on November 2,5
2010.6
Section 3. Be it further resolved that on the official ballot to be used at said election7
there shall be printed a proposition, upon which the electors of the state shall be permitted8
to vote FOR or AGAINST, to amend the Constitution of Louisiana, which proposition shall9
read as follows:10
To exempt state colleges and universities from the requirement that new fees11
or increases in existing fees be enacted by a two-thirds vote of the elected12
members of each house of the legislature.13
