SENATE BILL NO. 353
BY SENATORS NEVERS AND N. GAUTREAUX 
SCHOOLS. Requires a vote of the people before any local revenues can be transferred or
allocated to a charter school. (gov sig)
AN ACT1
To enact R.S. 17:3995(A)(7), relative to funding for charter schools; to prohibit the2
allocation or transfer of locally derived revenues to Type 2 charter schools without3
voter approval; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 17:3995(A)(7) is hereby enacted to read as follows: 6

(7) Notwithstanding any provision of law to the contrary, no funds10
received by a city, parish, or other local public school system that are derived11
from any local source of revenue shall be allocated or transferred under any12
circumstances or in any manner to a Type 2 charter school, without a favorable13
vote of a majority of the registered voters residing within the jurisdictional14
boundaries of the city, parish, or other local public school system within which15
the charter school is located, voting at an election held for such purpose.16

Section 2. This Act shall become effective upon signature by the governor or, if not1
signed by the governor, upon expiration of the time for bills to become law without signature2
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If3
vetoed by the governor and subsequently approved by the legislature, this Act shall become4
effective on the day following such approval.5

DIGEST
Proposed law provides that notwithstanding any provision of law to the contrary, no funds
received by a city, parish, or other local public school system that are derived from any local
source of revenue shall be allocated or transferred under any circumstances or in any manner
to a Type 2 charter school, without a favorable vote of a majority of the registered voters
residing within the jurisdictional boundaries of the city, parish, or other local public school
system within which the charter school is located, voting at an election held for such
purpose.
Effective upon signature of the governor or lapse of time for gubernatorial action.
