Regular Session, 2010 SENATE BILL NO. 354 BY SENATOR N. GAUTREAUX HORSE RACING. Requires the Louisiana Horsemens' Benevolent and Protection Association to submit an annual report to the legislative auditor. (8/15/10) AN ACT1 To amend and reenact R.S. 4:185(C) and to enact R.S. 4:185(D), relative to the Horsemen's2 Benevolent and Protection Association; to provide for annual audits; to provide for3 procedure; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 4:185(C) is hereby amended and reenacted and R.S. 4:185(D) is6 hereby enacted to read as follows: 7 ยง185. Horsemen's bookkeeper8 * * *9 C. The account shall at all times be subject to audit by the legislative auditor10 or by a certified public accountant approved by the legislative auditor, the expenses11 of such audit to be paid by the Horsemen's Benevolent and Protective Association.12 The Horsemen's Benevolent and Protective Association shall conduct, at its13 expense, annual financial audits of all of its operations and programs including14 the Horsemen's Bookkeeper Account. (2) Have a compliance component for purposes of determining1 compliance with those laws related to racing that are contained in this Part or2 otherwise specifically and expressly applicable to the Horsemen's Benevolent3 and Protective Association.4 (3) Be carried out in accordance with government audit standards at all5 times when auditing the Horsemen's Bookkeeper Account.6 (4) Be presented to the legislative auditor in their entirety promptly7 upon completion.8 D. The provisions of Subsection C of this Section shall be carried out in9 accordance with the terms contained in a cooperative endeavor agreement10 between the legislative auditor and the Horsemen's Benevolent and Protective11 Association as authorized by Article 7, Section 14(C) of the Louisiana12 Constitution of 1974 and without any other approvals or formalities for same13 being required.14 The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by Michelle Ducharme. DIGEST Present law requires that the Horsemen's Bookkeeper Account be subject to audits by the legislative auditor or by a certified public accountant approved by the legislative auditor, the expenses of such audit to be paid by the Horsemen's Benevolent and Protective Association ("HBPA".) Proposed law provides that the HBPA shall conduct, at its expense, annual financial audits of all of its operations and programs including the Horsemen's Bookkeeper Account. Provides that the annual audits shall: (1)Be conducted by certified public accountants who are on the legislative auditor's list of approved certified public accountants. (2)Have a compliance component for purposes of determining compliance with those laws related to racing or otherwise specifically and expressly applicable to the Horsemen's Benevolent and Protective Association. (3)Be carried out in accordance with government audit standards at all times when auditing the Horsemen's Bookkeeper Account. (4)Be presented to the legislative auditor promptly upon completion.
