AN ACT1
To enact R.S. 30:28.1, relative to drilling activities; to prohibit permitted oil and gas drilling2
activities from disturbing privately owned active water wells; to provide3
requirements and conditions; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 30:28.1 is hereby enacted to read as follows:6
ยง28.1.  Avoiding disturbance of privately owned water well7
A. An owner or operator of a permitted oil and gas well shall construct8
and maintain the drilling activity area in such a manner as to avoid disturbing9
the use of any privately owned active water well existing at the time of the10
application for the permit to drill.11
B.  An owner or operator of a permitted oil and gas well may negotiate12
with the owner of a privately owned active water well to relocate such water13
well. The owner or operator of a permitted oil and gas well shall pay for the14
relocation and plugging of the water well.15
