SENATE BILL NO. 365

PROCUREMENT CODE.  Provides relative to cooperative purchasing. (8/15/10)
AN ACT1
To enact R.S. 39:1701.1, relative to procurement; to provide relative to cooperative2
purchasing; to provide for a survey and report of cooperative purchasing; and to3
provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 39:1701.1 is hereby enacted to read as follows: 6
ยง1701.1.  Report to the legislature7
The office of state purchasing, or its successor agency, shall conduct a8
survey as to the utilization of the provisions of this Part and report the results9
thereof to the Joint Legislative Committee on the Budget no later than March10
1, 2011.11

Present law authorizes cooperative purchasing or procurement conducted by or on behalf of
more than one public procurement unit or by a public procurement unit with an external
procurement activity or by a private procurement unit. SB NO. 365

Present law authorizes a public procurement unit to participate in, sponsor, conduct, or
administer a cooperative purchasing agreement for the acquisition of supplies, services,
major repairs, or construction with one or more public procurement units or external
procurement activities or one or more private procurement units in accordance with an
agreement between the participants.
Proposed law retains present law and requires the office of state purchasing, or its successor
agency, to conduct a survey as to the use of the cooperative purchasing law and to report the
result to the Joint Legislative Committee on the Budget no later than March 1, 2011.
Effective August 15, 2010.
