Regular Session, 2010 ENROLLED SENATE BILL NO. 451 BY SENATOR CHEEK AN ACT1 To amend and reenact R.S. 37:3200 and 3208(B) and to enact R.S. 37:3220 and 3221,2 relative to the Radiologic Technology Board of Examiners; to provide for3 definitions; to provide for the issuance of permits and for certain clinical experience4 requirements; and to provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 37:3200 and 3208(B) are hereby amended and reenacted and R.S.7 37:3220 and 3221 are hereby enacted to read as follows: 8 §3200. Definitions 9 As used in this Chapter: 10 (1) "Board" means the Radiologic Technology Board of Examiners.11 (2) "Fusion technologist" means a person, other than a licensed12 practitioner, who under the direction and supervision of a licensed practitioner13 applies radiation while operating fusion technology imaging equipment or uses14 radioactive materials on humans for diagnostic or therapeutic purposes upon15 prescription of a licensed practitioner.16 (3) "Fusion technology" means the operation of positron emission17 tomography (PET) and computed tomography (CT) imaging equipment or any18 other hybrid imaging equipment identified and recognized by the board.19 (2) (4) "License" means a certificate issued by the board authorizing the20 licensee to use radioactive materials or equipment emitting or detecting ionizing21 radiation on humans for diagnostic or therapeutic purposes in accordance with the22 provisions of this Chapter.23 (3) (5) "Licensed practitioner" means a person licensed to practice medicine,24 dentistry, podiatry, chiropractic, or osteopathy in this state, or an advanced practice25 registered nurse licensed to practice in this state.26 (4) (6) "Nuclear medicine technologist" means a person, other than a licensed27 ACT No. 75 SB NO. 451 ENROLLED Page 2 of 3 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. practitioner, who under the direction and supervision of a licensed practitioner uses1 radioactive materials on humans for diagnostic or therapeutic purposes upon2 prescription of a licensed practitioner.3 (5) (7) "Radiation therapy technologist" means a person, other than a licensed4 practitioner, who under the direction and supervision of a licensed practitioner5 applies radiation to humans for therapeutic purposes upon prescription of a licensed6 practitioner.7 (6) (8) "Radiographer" means a person, other than a licensed practitioner,8 who under the direction and supervision of a licensed practitioner applies radiation9 to humans for diagnostic purposes upon prescription of a licensed practitioner.10 (7) (9) "Radiologic technologist" means any person who is a radiographer,11 a radiation therapy technologist, or a nuclear medicine technologist licensed under12 this Chapter who under the direction and supervision of a licensed practitioner13 applies radiation to humans upon prescription of a licensed practitioner.14 (8) (10) "Radiologic technology" means the use of a radioactive substance15 or equipment emitting or detecting ionizing radiation on humans for diagnostic or16 therapeutic purposes upon prescription of a licensed practitioner.17 (9) (11) "Radiological physicist" means a person who is certified by the18 American Board of Radiology in radiological physics or one of the subspecialties of19 radiological physics or who is eligible for such certification.20 (10) (12) "Radiologist" means a physician certified by the American Board21 of Radiology or the American Osteopathic Board of Radiology, the British Royal22 College of Radiology, or certified as a radiologist by the Canadian College of23 Physicians and Surgeons.24 * * *25 §3208. Qualifications of applicants26 * * *27 B. Temporary or limited purpose permits3 A. The board may:4 (1) Issue temporary permits authorizing the practice of radiologic or5 fusion technology for a designated period of time.6 (2) Issue permits for specific purposes with restrictions as to the type of7 radiologic or fusion technology activities that may be engaged in.8 (3) Issue permits to radiologic technologists participating in educational9 and training programs which include the administration of radiologic or fusion10 technology services to patients.11 B. The board may adopt rules and regulations, pursuant to the12 Administrative Procedure Act, which establish the necessary qualifications,13 requirements, and formalities for the issuance of such permits as are necessary14 for the adequate protection of the health and welfare of the citizens of this state.15 §3221. Clinical experience requirements for ARRT CT examination16 Under the authority granted by R.S. 37:3220, the board may issue a17 temporary permit authorizing the performance of the clinical requirements of18 the American Registry of Radiologic Technologists (ARRT) Computed19 Tomography (CT) specialty examination to a licensed nuclear medicine20 technologist while under the supervision of a licensed radiographer for a term21 not to exceed one year.22 PRESIDENT OF THE SENATE SPEAKER OF THE HOUSE OF REPRESENTATIVES GOVERNOR OF THE STATE OF LOUISIANA APPROVED:
