PUBLIC UTILITIES. Provides relative to the shifting of private mains to accommodate
public systems. (gov sig)
AN ACT1
To amend and reenact R.S. 33:4080(A), relative to the sewerage, water and drainage system2
of Orleans parish; to provide for the shifting of private transmission wires to3
accommodate the public system; and to provide for related matters.4
Notice of intention to introduce this Act has been published.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 33:4080(A) is hereby amended and reenacted to read as follows: 7
ยง4080.  Shifting private mains to accommodate public system8
A. Any person who has laid mains, pipes, or conduits, high voltage electric9
lines, telecommunication, fiber optic, or other transmission wires, or constructed10
any railroads, buildings, works, or structures of any kind in, on, or over the public11
streets, roads, drainage systems or canals, sewerage systems, or water systems may12
be compelled at his own cost and expense to shift or adjust any such mains, pipes,13
conduits, high voltage electric lines, telecommunication, fiber optic, or other14
transmission wires, or structures to the exigencies of the public sewerage and public15
water and drainage systems.16

Section 2. This Act shall become effective upon signature by the governor or, if not1
signed by the governor, upon expiration of the time for bills to become law without signature2
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If3
vetoed by the governor and subsequently approved by the legislature, this Act shall become4
effective on the day following such approval.5

DIGEST
Present law provides that, for properties within Orleans parish and under the jurisdiction of
the New Orleans Sewerage and Water Board, any person who has laid mains, pipes, or
conduits, or constructed any railroads, buildings, works, or structures of any kind in, on, or
over the public streets, roads, drainage systems or canals, sewerage systems, or water
systems may be compelled at his own cost and expense to shift or adjust any such mains,
pipes, conduits, or structures to the exigencies of the public sewerage and public water and
drainage systems.
Proposed law retains present law and adds that persons who have laid high voltage electric
lines, telecommunication, fiber optic, or other transmission wires may also be compelled at
their own expense to shift or adjust their property. 
Effective upon signature of the governor or lapse of time for gubernatorial action.
