SENATE BILL NO. 519

STATE EMPLOYEES.  Provides that GOHSEP employees are unclassified. (see Act)
AN ACT1
To amend and reenact R.S. 29:725(G)(2), relative to homeland security and emergency2
preparedness; to provide that all employees of GOHSEP serve at the pleasure of the3
governor as unclassified, state service employees; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1. R.S. 29:725(G)(2) is hereby amended and reenacted to read as follows:6

(2) All current and future employees of the Governor's Office of Homeland11
Security and Emergency Preparedness, including the director, deputy director and12
all other employees provided for in Paragraph (1) of the Subsection, shall serve13
at the pleasure of the governor and shall be subject to the laws, rules, and14
regulations governing employees in unclassified state service. Such employees shall15
remain in unclassified state service.16

Section 2.  This Act shall take effect and become operative if and when the1
proposed amendment of Article X, Sections 2(B)(11), (12) and (13) of the2
Constitution of Louisiana contained in Act 538 of the 2009 Regular Session of the3
Legislature is adopted at the statewide election to be held on October 2, 2010, and4
at the same time as such proposed amendment becomes effective.5

DIGEST
Present law provides that all current and future employees of the Governor's Office of
Homeland Security and Emergency Preparedness shall remain in unclassified state service.
Proposed law provides that the director, deputy director, and all employees of GOHSEP
shall be included as officers and employees in the state unclassified service and shall serve
at the pleasure of the governor.
Effective if and when the Constitutional Amendment prepared in Act 538 of the 2009
Regular Session of the Legislature is adopted at the elections held on October 2, 2010.
