Regular Session, 2010 SENATE BILL NO. 610 BY SENATOR ADLEY OWNERSHIP. Provides for a right of passage on a levee road under certain circumstances. (gov sig) AN ACT1 To enact R.S. 9:1255, relative to servitudes and rights of access; to provide for the right and2 servitude of passage upon certain levees; and to provide for related matters.3 Be it enacted by the Legislature of Louisiana:4 Section 1. R.S. 9:1255 is hereby enacted to read as follows: 5 ยง1255. Right and servitude of passage upon levees6 Notwithstanding any other provision of law to the contrary, when access7 to a public road is most accessible to a landowner by way of an existing levee8 road, the landowner may claim a right of passage on the levee road to the9 nearest public road. Access to the levee road shall not be denied.10 Section 2. This Act shall become effective upon signature by the governor or, if not11 signed by the governor, upon expiration of the time for bills to become law without signature12 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.
