SENATE BILL NO. 626
BY SENATOR MICHOT 
GAMING. Authorizes the Department of Public Safety and Corrections to administratively
adjust certain minimum fuel sales required of existing video poker truck stops. (8/15/10)
AN ACT1
To amend and reenact R.S. 27:306(A)(4)(b) and to enact R.S. 27:306(A)(10), relative to2
video poker; to authorize the Department of Public Safety and Corrections to adjust3
the minimum amount of fuel sales requirements for a certain number of devices; and4
to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 27:306(A)(4)(b) is hereby amended and reenacted and R.S.7
27:306(A)(10) is hereby enacted to read as follows: 8

(b) Except as provided for in Subparagraph (7)(a) and Paragraph (10) of12
this Subsection, the number of video draw poker devices placed at a qualified truck13
stop facility shall be based on the average monthly fuel sales calculated quarterly for14
the first year of operation and thereafter shall be based upon the average monthly15
fuel sales calculated annually as follows:16
(i) One hundred thousand gallons of fuel of which forty thousand gallons are17 SB NO. 626

diesel - not more than fifty devices.1
(ii) Seventy-five thousand gallons of fuel of which thirty thousand gallons are2
diesel - not more than forty devices.3
(iii) Fifty thousand gallons of fuel of which ten thousand are diesel - not more4
than thirty-five devices.5

(10)(a) The Department of Public Safety and Corrections is authorized7
to promulgate a rule adjusting the fuel requirements of Items (A)(4)(b)(i) and8
(ii) of this Subsection to a level not lower than that contained in Item9
(A)(4)(b)(iii).10
(b) For purposes of this Paragraph, notwithstanding the Administrative11
Procedure Act, the legislative oversight committee shall be the Joint Legislative12
Committee on the Budget and the rule shall not take effect without the13
affirmative approval of the committee.14

DIGEST
Present law, relative to video poker, provides that except for new licensees, the number of
video draw poker devices placed at a truck stop facility shall be based on the average
monthly fuel sales calculated quarterly for the first year of operation and thereafter based
upon the average monthly fuel sales calculated annually.  Provides the maximum allowable
video poker devices based on fuel sold in the following categories:
(1)100,000 gallons of fuel of which 40,000 gallons are diesel - not more than 50 video
poker devices.
(2)75,000 gallons of fuel of which 30,000 gallons are diesel - not more than 40 video
poker devices.
(3)50,000 gallons of fuel of which 10,000 gallons are diesel - not more than 35 video

Proposed law allows the Department of Public Safety and Corrections to promulgate a rule
adjusting the fuel requirements of categories (1) and (2) to a level not lower than that
contained in category (3). Provides that for purposes of proposed law, notwithstanding the
provision of the Administrative Procedures Act, the legislative oversight committee shall be
Joint Legislative Committee on the Budget and the rule shall not take effect without the
affirmative approval of the committee.
