(8/15/10) AN ACT1 To amend and reenact R.S. 37:3392(1) and (3), relative to real estate appraisers; to require2 real estate appraisers to consider energy efficiency aspects when assigning value to3 certain property; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 37:3392(1) and (3) are hereby amended and reenacted to read as6 follows: 7 ยง3392. DIGEST Hebert (SB 648) Present law defines "appraisal" or "real estate appraisal" as an analysis, opinion, or conclusion relating to the nature, quality, value, or utility of specified interests in, or aspects of, identified real estate, for or in expectation of compensation. Proposed law retains present law but allows that energy efficiency aspects of the identified real estate to be considered in determining the appraisal. Present law defines "appraisal report" as any communication, written or oral, of an analysis, opinion, or conclusion relating to the nature, quality, value, or utility of specified interests in, or aspects of, identified real estate. Proposed law retains present law but allows that energy efficiency aspects of the identified real estate to be considered in the appraisal report. Effective August 15, 2010.
