Regular Session, 2010 SENATE BILL NO. 66 BY SENATOR MORRELL SCHOOLS. Authorizes establishment of an enrollment preference for neighborhood students for certain charter schools. (gov sig) AN ACT1 To amend and reenact R.S. 17:3991(B)(4) and to enact R.S. 17:3991(C)(1)(d), relative to2 charter schools; to provide relative to authorization for certain charter schools to3 establish an enrollment preference for students residing in the immediate4 neighborhood surrounding the school; to provide relative to the determination of the5 geographic boundaries of each such neighborhood; to provide for effectiveness; and6 to provide for related matters.7 Be it enacted by the Legislature of Louisiana:8 Section 1. R.S. 17:3991(B)(4) is hereby amended and reenacted and R.S.9 17:3991(C)(1)(d) is hereby enacted to read as follows:10 ยง3991. Charter schools; requirements; limitations; renewal; amendment; revocation11 * * *12 B. A charter school shall:5 (1) 6 * * *7 (d) Beginning with the 2011-2012 school year, each elementary and8 middle charter school, other than a Type 2 charter school, may request from9 and be granted by its chartering authority the authority to give preference in10 its enrollment procedures to students residing within the neighborhood11 immediately surrounding the school. The geographic boundaries of the12 neighborhood immediately surrounding such school shall be determined by the13 school's chartering authority.14 * * *15 Section 2. This Act shall become effective upon signature by the governor or, if not16 signed by the governor, upon expiration of the time for bills to become law without signature17 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. DIGEST Morrell (SB 66) Proposed law allows an elementary or middle charter school, other than a Type 2 charter school, beginning with the 2011-2012 school year, to request from and be granted by its chartering authority the authority to give preference in its enrollment procedures to students residing with the neighborhood immediately surrounding the school. Further provides that the geographic boundaries of the neighborhood immediately surrounding such school shall be determined by the school's chartering authority. Requires each proposed charter to include a description of the geographic boundaries circumscribing the neighborhood immediately surrounding the charter school from which students residing within may be given preference for enrollment. (Amends R.S. 17:3991(B)(4); adds R.S. 17:3991(C)(1)(d)) Summary of Amendments Adopted by Senate Committee Amendments Proposed by Senate Committee on Education to the original bill. 1. Removes requirement that each charter school establish an enrollment preference for neighborhood students. 2. Limits applicability to elementary and middle charter schools, other than Type 2 charters. 3. Allows eligible charter schools to request and be granted authority from their chartering authority to establish an enrollment preference, beginning in 2010- 2011. 4. Deletes requirement that a specified percentage of a charter school's enrollment be composed of neighborhood students.
