SENATE BILL NO. 708
BY SENATOR CHABERT 
PUBLIC CONTRACTS.  Increases the contract limit from one to two million dollars until
December 31, 2014, for any project to restore or rehabilitate a levee not maintained with
federal funds or to perform mitigation on public lands where the project is undertaken by a
public entity with its own resources and employees or with the resources and employees of
another public entity through a cooperative endeavor or other agreement with such entity.

AN ACT1
To amend and reenact R.S. 38:2212(A)(1)(d)(v)(aa) and (bb), relative to public contracts for2
levees which are not maintained with federal funds; to change the termination date3
for contracts awarded for certain projects providing for the restoration and4
rehabilitation of certain levees under certain circumstances or agreements for certain5
mitigation on public lands; to provide terms and conditions; to provide an effective6
date; and to provide for related matters.7
Be it enacted by the Legislature of Louisiana:8
Section 1. R.S. 38:2212(A)(1)(d)(v)(aa) and (bb) are hereby amended and reenacted9
to read as follows: 10
§2212. Advertisement and letting to lowest responsible bidder; public work;11
electronic bidding; participation in mentor-protégé program;12

perform mitigation on public lands owned by the state or a political subdivision,1
shall be equal to the sum of one two million dollars; provided that the project is2
undertaken by the public entity with its own resources and employees, or with the3
resources and employees of another public entity through a cooperative endeavor or4
other agreement with such entity.5
(bb) The provisions of this Item shall remain effective for contracts awarded,6
or agreements entered into, until December 31, 2010 2014.7

Section 2. This Act shall become effective upon signature by the governor or, if not9
signed by the governor, upon expiration of the time for bills to become law without signature10
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If11
vetoed by the governor and subsequently approved by the legislature, this Act shall become12
effective on the day following such approval.13

DIGEST
Present law provides that the contract limit for any contract by a public entity to restore or
rehabilitate a levee which is not maintained with federal funds or to perform mitigation on
public lands owned by the state or a political subdivision shall be equal to the sum of
$1,000,000, provided that the project is undertaken by the public entity with its own
resources and employee s or with the resources and employees of another public entity
through a cooperative endeavor or other agreement with such entity.
Present law further provides for a termination date of December 31, 2010, for the contract
limit for such public entity projects undertaken pursuant to the above exception under
present law.
Proposed law increases the contract limit for such projects from $1,000,000 to $2,000,000
and changes the termination date from December 31, 2010 to December 31, 2014.
Effective upon signature of the governor or lapse of time for gubernatorial action.
