PUBLIC CONTRACTS. Extends until December 31, 2014 the $1,000,000 contract limit
for any contract by a public entity for levees not maintained with federal funds or to perform
mitigation on public lands if the project is undertaken with the public entity's own resources
and employees or with the resources and employees of another public entity through an
agreement with another public entity. (gov sig)
AN ACT1
To amend and reenact R.S. 38:2212(A)(1)(d)(v)(bb), relative to public contracts for levees2
which are not maintained with federal funds; to change the termination date for3
contracts awarded for certain projects providing for the restoration and rehabilitation4
of certain levees under certain circumstances or agreements for certain mitigation on5
public lands; to provide terms and conditions; to provide an effective date; and to6
provide for related matters.7
Be it enacted by the Legislature of Louisiana:8
Section 1. R.S. 38:2212(A)(1)(d)(v)(bb) are hereby amended and reenacted to read9
as follows: 10
§2212. Advertisement and letting to lowest responsible bidder; public work;11

or agreements entered into, until December 31, 2010 2014.1

Section 2. This Act shall become effective upon signature by the governor or, if not3
signed by the governor, upon expiration of the time for bills to become law without signature4
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If5
vetoed by the governor and subsequently approved by the legislature, this Act shall become6
effective on the day following such approval.7

Present law provides that the contract limit for any contract by a public entity to restore or
rehabilitate a levee which is not maintained with federal funds or to perform mitigation on
public lands owned by the state or a political subdivision shall be equal to the sum of
$1,000,000, provided that the project is undertaken by the public entity with its own
resources and employees or with the resources and employees of another public entity
through a cooperative endeavor or other agreement with such entity.
Present law further provides for a termination date of December 31, 2010.
Proposed law changes the termination date from December 31, 2010 to December 31, 2014.
Effective upon signature of the governor or lapse of time for gubernatorial action.
