Regular Session, 2010 SENATE BILL NO. 74 BY SENATOR MORRELL SCHOOLS. Provides for the creation of community advisory committees for schools in the Recovery School District. (gov sig) AN ACT1 To enact R.S. 17:1990(I) and (J), relative to the Recovery School District; to provide for the2 creation of community advisory boards for schools within the district; to provide3 relative to the membership, duties, and functions of such boards; to prohibit the State4 Board of Elementary and Secondary Education from approving a charter school5 within the district for which there is not more than one applicant; and to provide for6 related matters.7 Be it enacted by the Legislature of Louisiana:8 Section 1. R.S. 17:1990(I) and (J) are hereby enacted to read as follows:9 ยง1990. Recovery School District; creation; governance; operation10 * * *11 I. (c) One member appointed by the elected head of the governing1 authority of the parish in which the school is located.2 (d) One member appointed by the elected member of the parish3 governing authority in whose district the school is located.4 (e) One member appointed by the member of the city, parish, or other5 local public school board in whose district the school is located.6 (f) One member appointed by the member of the State Board of7 Elementary and Secondary Education in whose district the school is located.8 (g) One member appointed by the president of the State Board of9 Elementary and Secondary Education, in the case of a school directly operated10 by the Recovery School District, or, in the case of a charter school, the school's11 chartering authority.12 (2) A community advisory board shall be established for each school13 directly operated by the Recovery School District, not later than August 15,14 2010.15 (3) A community advisory board shall be established for each new16 charter school created within the Recovery School District at the time such17 school is created, and provision for a community advisory board as provided in18 this Subsection shall be made a part of the charter agreement.19 (4) A community advisory board shall be established for each existing20 charter school within the Recovery School District at the time such school's21 charter is up for renewal, and provision for a community advisory board as22 provided in this Subsection shall be made a part of the school's charter upon23 renewal.24 (5) Prior to taking action to convert a school directly operated by the25 Recovery School District to a charter school, or to authorize the creation of a26 new charter school within the Recovery School District, the State Board of27 Elementary and Secondary Education shall consult with such school's28 community advisory board when selecting a charter operator for the school.29 SB NO. 74 SLS 10RS-571 ORIGINAL Page 3 of 4 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. J. The State Board of Elementary and Secondary Education shall not1 approve the conversion of an existing school directly operated by the Recovery2 School District to a charter school, or the creation of a new charter school3 within the Recovery School District, for which there is not more than one4 applicant to operate such school.5 Section 2. This Act shall become effective upon signature by the governor or, if not6 signed by the governor, upon expiration of the time for bills to become law without signature7 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If8 vetoed by the governor and subsequently approved by the legislature, this Act shall become9 effective on the day following such approval.10 The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by Jeanne C. Johnston. DIGEST Proposed law provides for the establishment of a community advisory board for each school within the Recovery School District (RSD), composed of seven members as follows: 1. One member appointed by the state senator in whose district the school is located. 2. One member appointed by the state representative in whose district the school is located. 3. One member appointed by the elected head of the governing authority of the parish in which the school is located. 4. One member appointed by the elected member of the parish governing authority in whose district the school is located. 5. One member appointed by the member of the city, parish, or other local public school board in whose district the school is located. 6. One member appointed by the member of the State Board of Elementary and Secondary Education (BESE) in whose district the school is located. 7. One member appointed by the president of BESE, in the case of a school directly operated by the RSD, or, in the case of a charter school, the school's chartering authority. Proposed law : 1. Requires that a community advisory board be established for each school directly operated by the RSD not later than August 15, 2010. 2. Requires that a community advisory board be established for each new charter school created within the RSD at the time such school is created and that such advisory board be made a part of the charter agreement. Requires BESE, prior to taking action to convert a school directly operated by the RSD to a charter school, or to authorize the creation of a new charter school within the RSD, to consult with such school's community advisory board when selecting a charter operator for the school. Proposed law prohibits BESE from approving the conversion of an existing school directly operated by the RSD to a charter school, or the creation of a new charter school within the RSD, for which there is not more than one applicant to operate such school.
