PUBLIC CONTRACTS. Provides relative to state purchasing, the powers and duties of the
state director of purchasing, competitive sealed bidding, and sole source selection. (7/1/10)
AN ACT1
To amend and reenact R.S. 39:1564(B) and (C), 1594(C)(2), and 1597, relative to state2
purchasing; to provide for the powers and duties of the state director of purchasing;3
to provide relative to competitive sealed bidding; to provide for sole source4
selection; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 39:1564(B) and (C), 1594(C)(2), and 1597 are hereby amended and7
reenacted to read as follows: 8
§1564.  Authority of the state director of purchasing9

B. Power to adopt rules. Consistent with the provisions of this Chapter, the11
director may adopt rules, in accordance with the Administrative Procedure Act,12
governing the internal procedures of the central purchasing agency.13
C. Duties. Except as otherwise specifically provided in this Chapter, the14
director shall, within the limitations of regulations promulgated by the15
commissioner, and otherwise in accordance with law:16

§1594. Competitive sealed bidding1

(2) The advertisements or written notices shall contain general descriptions5
of the supplies, services, or major repairs for which bids are wanted and shall state:6
(a) The names and locations of the departments or institutions for which the7
purchases are to be made.8
(b) Where and how specifications and quotation forms may be obtained, and.9
(c) The date and time not later than which bids must be received and will be10
opened.11

§1597.  Sole source procurements procurement13
A contract may be awarded for a required supply, service, or major repair14
without competition when, under regulations, the chief procurement officer or his15
designee above the level of procurement officer determines in writing that there is16
only one source for the required supply, service, or major repair item.17
Section 2. This Act shall become effective on July 1, 201018

DIGEST
Present law, relative to state purchasing, provides that the state director of purchasing,
consistent with present law, may adopt rules governing the internal procedures of the central
purchasing agency. Proposed law retains present law, but requires that such rules be adopted
in accordance with the APA.
Present law provides that except as otherwise specifically provided in 	present law, the
director shall, within the limitations of regulations promulgated by the commissioner of
administration:
(1) Procure or supervise the procurement of all supplies, services, and major repairs
needed by the state.
(2) Exercise supervision over all inventories of warehoused supplies belonging to the

(3) Establish and maintain programs for the inspection, testing, and acceptance of
supplies, services, and major repairs.
Proposed law requires that such action be taken in accordance with law; otherwise retains
present law.
Present law, relative to competitive sealed bidding for state purchases, requires that the
advertisements or written notices contain general descriptions of the supplies, services, or
major repairs for which bids are wanted and state:
(1) The names and locations of the departments or institutions for which the purchases
are to be made.
(2)Where and how specifications and quotation forms may be obtained.
(3)The date and time not later than which bids must be received and will be opened.
Proposed law makes technical correction; otherwise retains present law.
Present law, relative to sole source procurement, provides that a contract may be awarded
for a required supply, service, or major repair without competition when, under regulations,
the chief procurement officer or his designee above the level of procurement officer
determines in writing that there is only one source for the required supply, service, or major
repair item. Proposed law makes technical correction; otherwise retains present law.
Effective July 1, 2010.
