AN ACT1
To enact Chapter 64 of Title 46 of the Louisiana Revised Statutes of 1950, to be comprised2
of R.S. 46:2891, relative to Medicaid upper payment limit collaboratives; to provide3
for a Medicaid upper payment limit collaborative to continue access to healthcare4
services; to provide for development of funding mechanisms for hospitals; and to5
provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  Chapter 64 of Title 46 of the Louisiana Revised Statutes of 1950,8
comprised of R.S. 46:2891, is hereby enacted to read as follows:9
CHAPTER 64. PUBLIC/PRIVATE UPPER PAYMENT LIMIT COLLABORATIVE10
ยง2891. Public /Private upper payment limit collaborative11
The Department of Health and Hospitals is hereby authorized to develop12
mechanisms to support the continued operation of state-funded health care13
programs through public/private collaborations with hospitals and health14
systems that desire to partner with the state. The partnerships shall be designed15
to ensure the efficient use of the parties' resources and to continue access to16

develop, subject to federal law and the approval of the Centers for Medicare1
and Medicaid Services, additional funding mechanisms for hospitals to assist in2
the provision of care for the poor.3
Section 2. This Act shall become effective upon signature by the governor or, if not4
signed by the governor, upon expiration of the time for bills to become law without signature5
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If6
vetoed by the governor and subsequently approved by the legislature, this Act shall become7
effective on the day following such approval.8

Proposed law authorizes DHH to develop mechanisms to support the continued operation
of state-funded health care programs through public/private collaborations with hospitals and
health systems that desire to partner with the state.
