First Extraordinary Session, 2011 HOUSE BILL NO. 34 BY REPRESENTATIVE GALLOT REAPPORTIONMENT/BES E: Provides relative to election districts for members of the Board of Elementary and Secondary Education (Item #4) AN ACT1 To enact R.S. 17:2.1 and to repeal R.S. 17:2.2, relative to redistricting; to provide for2 election districts for the State Board of Elementary and Secondary Education; to3 provide for election of members; to provide for effectiveness; and to provide for4 related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 17:2.1 is hereby enacted to read as follows: 7 ยง2.1. Districts for election of members of the State Board of Elementary and 8 Secondary Education9 A. Louisiana shall be divided into eight districts for the election of eight of10 the members of the State Board of Elementary and Secondary Education. (A) The precincts referenced in this Act are those precincts identified as6 Voting Districts (VTDs) in the 2010 Census Redistricting TIGER/Line Shapefiles for the7 State of Louisiana.8 (B) When a precinct referenced in this Act has been subdivided by action of the9 parish governing authority on a nongeographic basis or subdivided by action of the parish10 governing authority on a geographic basis in accordance with the provisions of R.S.11 18:532.1, the enumeration in this Act of the general precinct designation shall include all12 nongeographic and all geographic subdivisions thereof, however such subdivisions may be13 designated. The territorial limits of the districts as p rovided in this Act shall continue in14 effect without change regardless of any changes made to the precincts by the parish15 governing authority.16 Section 3. R.S. 17:2.2 is hereby repealed in its entirety.17 Section 4.(A) Section 1 of this Act shall become effective solely for the purposes of18 qualifying and election of members of the State Board of Elementary and Secondary19 Education at the regularly scheduled elections in 2011, upon signature of this Act by the20 governor or, if not signed by the governor, upon expiration of the time for bills to become21 law without signature by the governor, as provided in Article III, Section 18 of the22 Constitution of Louisiana. If this Act is vetoed by the governor and subsequently approved23 by the legislature, Section 1 of this Act shall become effective for such purposes on the day24 following such approval.
