HOUSE BILL NO. 36
BY REPRESENTATIVE DIXON
REAPPORTIONMENT/JUDGES:  Provides for election sections in the Court of Appeal for
the Third Circuit (Item #7)
AN ACT1
To amend and reenact R.S. 13:312(3)(b)(i) and 312.1(C), relative to the Court of Appeal for2
the Third Circuit; to provide election sections for the election of judges to the first3
district of the Court of Appeal for the Third Circuit; to provide for the assignment4
of judgeships for election purposes; to provide for the election of judges; to provide5
for effectiveness; and to provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section
 1. R.S. 13:312(3)(b)(i) and 312.1(C) are hereby amended and reenacted to8
read as follows: 9
§312.  Courts of appeal; circuits and districts10
There shall be five court of appeal circuits, which shall be subdivided into11
districts as follows:12

(b)  Districts of third circuit.16
(i) The parishes of Avoyelles, Catahoula, Concordia, Grant, LaSalle,17
Natchitoches, Rapides, and Sabine shall compose the first district of the third circuit.18
The first district shall be further divided into two election sections.

(aa) Election section one shall be composed of Avoyelles Parish; Catahoula20
Parish; Concordia Parish; Precincts 1-1, 1-2, 1-3, 2-2, 2-3, 4-1, 4-2, 5-1, 5-2, 6-1,21
6-2, 6-3, 7-1, 7-2, 7-3, 7-4, 8-1, 8-2 and 8-3 of Grant Parish; La Salle Parish;22

(bb) Election section two shall be composed of Precincts 2-1, 3-1, 3-2 and5
3-3 of Grant Parish; Precincts 1-1, 1-1A, 1-2, 1-3, 1-3A, 1-4, 1-4A, 1-4B, 1-5, 1-5A,6
1-6, 1-7, 1-8, 1-9, 1-9A, 1
-10, 1-10A, 1-10B, 1-11, 1-12, 1-13, 1-14, 2-1, 2-2, 2-3,

 and Precincts C1, C2, C3, C4,

§312.1.  Circuit court of appeal; domicile; number of judges; election14
*          *          *15
C.  The Court of Appeal for the Third Circuit, domiciled in the city of Lake16
Charles, shall have twelve judges. Three judges shall be elected from the first17
district at large by the qualified electors thereof by electing two
 judges from election

section one and by electing one judge from election section two of the first district19
as provided in R.S. 13:312(3); three judges shall be elected from the second district20
by electing one judge from election section one and by electing two judges from21
election section two of the second district as provided in R.S. 13:312(3); and six22
judges shall be elected from the third district by electing one judge from each of the23
five election sections as provided in R.S. 13:312(3), and by electing one judge from24
the third district at large.25

Section
 2.(A)  The precincts referenced in this Act are those precincts 	identified as27
Voting Districts (VTDs) in the 2010 Census Redistricting TIGER/Line Shapefiles for the28

(B) When a precinct referenced in this Act has been subdivided by action of the1
parish governing authority on
 a nongeographic basis or subdivided by action of the parish2
governing authority on a geographic basis in accordance with the provisions of R.S.3
18:532.1, the enumeration in this Act of the general precinct designation shall include all4
nongeographic and all geographic subdivisions thereof, however such subdivisions may be5
designated. The territorial limits of the election sections as provided in this Act shall6
continue in effect without change regardless of any changes made to the precincts by the7
parish governing authority.8
Section
 3.(A) The judgeships currently designated as Division B and Division C of9
the first district of the Court of Appeal for the Third Circuit are hereby assigned to election10
section one for election purposes.11
(B) The judgeship currently designated as Division A of the first district of the Court12
of Appeal for the Third Circuit is hereby assigned to election section two for election13
purposes.14
Section
 4. This Act shall become effective upon signature by the governor or, if not15
signed by the governor, upon
 expiration of the time for bills to become law without signature16
by the governor, as provided by Article III, Section
 18 of the Constitution of Louisiana.  If17
vetoed by the governor and subsequently approved by the legislature, this Act shall become18
effective on the day following such approval.19

Present law provides that the first district of the Court of Appeal for the Third Circuit is
comprised of Avoyelles, Catahoula, Concordia, Grant, LaSalle, Natchitoches, Rapides, and

Proposed law divides the first district into two election sections.  Provides that two judges
are elected from election section one and that one judge is elected from election section two.
Provides that the judgeships currently designated as Division B and Division C of the first
district are assigned to election section one for election purposes.  Provides that the
judgeship currently designated as Division A of the first district is assigned to election
section two for election purposes.
Proposed law specifies that the precincts referenced in proposed law are those precincts
identified as Voting Districts (VTDs) in the 2010 Census Redistricting TIGER/Line
Shapefiles for the state of La. Provides that when a precinct referenced in p
roposed law
 has
been subdivided by action of the parish governing authority on
 a nongeographic basis or

with the provisions of present law
 (R.S. 18:532.1), the enumeration in proposed law of the
