REAPPORTIONMENT/CON GRESS:  Provides relative to the districts for elected members
of the United States Congress (Item #3)
AN ACT1
To enact R.S. 18:1276.1 and to repeal R.S. 18:1276, relative to congressional districts; to2
provide for the redistricting of Louisiana's congressional districts; to provide with3
respect to positions and offices, other than congressional, which are based upon4
congressional districts; to provide for the effectiveness; and to provide for related5
matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 18:1276.1 is hereby enacted to read as follows: 8
ยง1276.1.  Congressional districts
9
Louisiana shall be divided
 into six congressional districts, and the qualified
10
electors of each district shall elect one representative to the United States House of11
Representatives.  The districts shall be composed as follows:12

Section
 2.(A) The precincts referenced in this Act are those Voting Districts (VTDs)6
contained in the 2010 Census Redistricting TIGER/Line Shapefiles for the State of7
Louisiana.8
(B) When a precinct referenced in this Act has been subdivided by action of the9
parish governing authority on
 a nongeographic basis or subdivided by action of the parish10
governing authority on
 a geographic basis in accordance with the provisions of R.S.11
18:532.1, the enumeration in this Act of the general precinct designation shall include all12
nongeographic and all geographic subdivisions thereof, however such subdivisions may be13
designated. The territorial limits of the districts as provided in this Act shall continue in14
effect without change regardless of any changes made to the precincts by the parish15
governing authority.16
Section
 3. The provisions of this Act shall not reduce the term of office of any17
person holding any position or office on
 the effective date of this Section, for which the18
appointment or election is based upon
 a congressional district as composed pursuant to R.S.19
18:1276.  Any position or office filled after January 3, 2013, for which the appointment or20
election is based on a congressional district shall be appointed or elected from a district as21
it is described in this Act.22
Section 4.  R.S. 18:1276 is hereby repealed in its entirety.23
Section
 5.(A) The provisions of Section 1 of this Act shall become effective solely24
for the purposes of the election of representatives to the United States Congress at the next25
regularly scheduled election for representatives to the congress in 2012,
 commencing on the26
date and at the time that the qualifying period opens for such offices.  The effectiveness of27
Section
 1 of this Act for such purposes shall not reduce the term of office of any member of28
the congress elected at the 2010

remainder of a term which b
egan on January 3, 2011, or change the district which any1
member of congress represents pursuant to R.S. 18:1276.  For subsequent elections of2
representatives to the United States Congress and for all other purposes, the provisions of3
Section 1 of this Act shall become effective at noon on the third day of January in 2013.4
(B)  The provisions of Section 4 of this Act shall become effective at noon on the5
third day of January in 2013.6
(C) The provisions of  this Section and Sections 2 and 3 of this Act shall become7
effective upon
 signature of this Act by the governor or, if not signed by the governor, upon8
expiration of the time for bills to become law without signature by the governor, as provided9
in Article III, Section 18 of the Constitution of Louisiana.  If this Act is vetoed by the10
governor and subsequently approved by the legislature, the provisions of this Section and11
Sections 2 and 3 of this Act shall become effective on the day following such approval.12

Present U.S. Constitution
 (14th Amendment) provides that representatives in congress shall
be apportioned among the several states according to their respective numbers, counting the
