First Extraordinary Session, 2011 HOUSE BILL NO. 6 BY REPRESENTATIVE PONTI REAPPORTIONMENT/CON GRESS: Provides relative to the districts for elected members of the United States Congress (Item #3) AN ACT1 To enact R.S. 18:1276.1 and to repeal R.S. 18:1276, relative to congressional districts; to2 provide for the redistricting of Louisiana's congressional districts; to provide with3 respect to positions and offices, other than congressional, which are based upon4 congressional districts; to provide for the effectiveness; and to provide for related5 matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. The territorial limits of the districts as provided in this Act shall continue in14 effect without change regardless of any changes made to the precincts by the parish15 governing authority.16 Section 3. The provisions of this Act shall not reduce the term of office of any17 person holding any position or office on the effective date of this Section, for which the18 appointment or election is based upon a congressional district as composed pursuant to R.S.19 18:1276. Any position or office filled after January 3, 2013, for which the appointment or20 election is based on a congressional district shall be appointed or elected from a district as21 it is described in this Act.22 Section 4. R.S. 18:1276 is hereby repealed in its entirety.23 Section 5.(A) The provisions of Section 1 of this Act shall become effective solely24 for the purposes of the election of representatives to the United States Congress at the next25 regularly scheduled election for representatives to the congress in 2012, commencing on the26 date and at the time that the qualifying period opens for such offices. For subsequent elections of2 representatives to the United States Congress and for all other purposes, the provisions of3 Section 1 of this Act shall become effective at noon on the third day of January in 2013.4 (B) The provisions of Section 4 of this Act shall become effective at noon on the5 third day of January in 2013.6 (C) The provisions of this Section and Sections 2 and 3 of this Act shall become7 effective upon signature of this Act by the governor or, if not signed by the governor, upon8 expiration of the time for bills to become law without signature by the governor, as provided9 in Article III, Section 18 of the Constitution of Louisiana. If this Act is vetoed by the10 governor and subsequently approved by the legislature, the provisions of this Section and11 Sections 2 and 3 of this Act shall become effective on the day following such approval.12 DIGEST The digest printed below was prepared by House Legislative Services. Shapefiles for the state of La. Also specifies that if any such precinct has been subdivided by action of the parish governing authority on a nongeographic basis or subdivided by action of the parish governing authority on a geographic basis in accordance with present law , the enumeration of the general precinct designation shall include all nongeographic and all geographic subdivisions thereof. Further provides that the territorial limits of the districts as enacted shall continue in effect without change regardless of any changes made to the precincts by the parish governing authority. Proposed law specifies that the effectiveness of the law for 2012 election purposes does not reduce the term of congressmen elected at the 2010 congressional election or elected to fill a vacancy for the remainder of a term which began on Jan. 3, 2011.
