First Extraordinary Session, 2011 ENROLLED SENATE BILL NO. 15 BY SENATOR CLAITOR AN ACT1 To amend and reenact R.S. 43:140(5), 142(B), 171(B), 200(5), and 201(C), relative to2 provisions of Title 43 (Public Printing and Advertisements) of the Louisiana Revised3 Statutes of 1950, which are limited in applicability to certain political subdivisions4 or local areas based upon population classifications; to specify applicability to one5 or more political subdivisions or local areas; and to provide for related matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. R.S. 43:140(5), 142(B), 171(B), 200(5), and 201(C) are hereby amended8 and reenacted to read as follows: 9 §140. Definitions 10 As used in this Chapter, the following terms shall have the meanings ascribed11 to them in this Section: 12 * * *13 (5) "Office" shall mean the newspaper's principal public business office and14 need not be the place at which the newspaper's printing presses are physically15 located. A newspaper shall have only one principal public business office; however,16 any newspaper with a principal business office in a parish adjoining Jefferson17 Parish which within one year prior to June 1, 1986, has actually published official18 proceedings of any municipal corporation, parish council, police jury, or school19 board of a parish having a population of not less than four hundred thousand and20 adjoining the parish where the newspaper maintains its principal public business21 office, in Jefferson Parish shall be deemed to be published in an office physically22 located in both the parish where the newspaper maintains its principal business office23 and the adjoining parish Jefferson Parish.24 * * *25 §142. The provisions of this Section relating to the five year requirement shall1 not contravene any contract existing between any governing body and a newspaper2 on and prior to May 11, 1970; nor shall the five year requirement herein be applied3 in assessing the qualifications of a newspaper which was in existence on May 11,4 1970; nor shall any provision of this Chapter prohibit a publication from becoming5 an official journal in a parish having a population of not less than four hundred6 thousand Jefferson Parish when the publication has actually published official7 proceedings within one year prior to June 1, 1986 of any municipal corporation,8 parish council, police jury, or school board within that parish Jefferson Parish.9 * * *10 §171. Selection of newspaper11 * * *12 B. The provisions of this Section relating to the five year requirement shall13 not contravene any contract existing between any governing body and a newspaper14 on and prior to May 11, 1970; nor shall the five year requirement herein be applied15 in assessing the qualifications of a newspaper which was in existence on May 11,16 1970; nor shall any provision of this Chapter prohibit a publication from becoming17 an official journal in a parish having a population of not less than four hundred18 thousand Jefferson or Orleans Parish when the publication has actually published19 official proceedings within one year prior to June 1, 1986 of any municipal20 corporation, parish council, police jury, or school board within that parish Jefferson21 or Orleans Parish.22 * * *23 §200.
