First Extraordinary Session, 2011 SENATE BILL NO. 2 BY SENATOR KOSTELKA REAPPORTIONMENT. Provides for redistricting of Louisiana's congressional districts. AN ACT1 To enact R.S. 18:1276.1 and to repeal R.S. 18:1276, relative to congressional districts; to2 provide for the redistricting of Louisiana's seven congressional districts into six3 congressional districts; to provide relative to the terms of members of congress4 serving on the effective date of the Act; to provide for the filling of vacancies; to5 provide relative to positions and offices, other than congressional, that are based6 u pon congressional districts; to provide for the effectiveness of the Act; and to7 provide for related matters.8 Be it enacted by the Legislature of Louisiana:9 Section 1. R.S. 18:1276.1. is hereby enacted to read as follows:10 ยง1276.1. Congressional districts 11 A. B. The precincts referenced in this Section are those precincts identified1 as Voting Districts (VTDs) in the 2010 Census Redistricting TIGER/Line 2 Shapefiles for the State of Louisiana.3 C. When a precinct referenced in this Section has been subdivided by4 action of the parish governing authority on a nongeographic basis or subdivided5 by action of the parish governing authority on a geographic basis in accordance6 with the provisions of R.S. 18:532.1, the enumeration in this Section of the7 general precinct designation shall include all nongeographic and all geographic8 subdivisions thereof, however such subdivisions may be designated. The9 territorial limits of the districts as provided in this Section shall continue in10 effect without change regardless of any changes made to the precincts by the11 parish governing authority.12 D. This Section shall not reduce the term of office of any member of13 congress who was elected at the 2010 congressional election or who was elected 14 to fill a vacancy for the remainder of a term that began on January 3 , 2011.15 E. A vacancy in the representation of any congressional district that is16 filled after January 3, 2013, shall be filled as provided by law from that district17 as it is described in this Section.18 F. This Section shall not reduce the term of office of any person holding19 any position or office on January 3, 2013, for which the appointment or election20 is based upon a congressional district. Any position or office filled after 21 January 3, 2013, for which the appointment or election is based on a22 congressional district shall be appointed or elected from that district as it is23 described in this Section.24 Section 2. R.S. 18:1276 is hereby repealed effective at noon on January 3, 2013.25 Section 3. The provisions of Section 1 of this Act shall become effective solely for26 the purposes of the election of representatives to the United States Congress at the next27 regularly scheduled election for representatives to the congress in 2012, commencing on the28 date and at the time that the qualifying period opens for such offices. Section 1 of this Act for such purposes shall not reduce the term of office of any member of1 the congress or change the district which any member represents pursuant to R.S. 18:1276.2 For subsequent elections of representatives to the United States Congress and for all other3 purposes, the provisions of Section 1 of this Act shall become effective at noon on January4 3, 2013.5 The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by Alden A.
