CRIMINAL/BAIL:  Provides for the suspension of a driver's license following a vehicular
homicide arrest
AN ACT1
To enact Code of Criminal Procedure Article 336.3, relative to conditions of release on bail;2
to authorize the suspension of a driver's license as a condition of release on bail for3
any person arrested for vehicular homicide; to provide for procedures; and to provide4
for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. Code of Criminal Procedure Article 336.3 is hereby enacted to read as7
follows: 8
Art. 336.3. Conditions of release on bail; suspension of driver's license upon arrest9
for vehicular homicide10
A. The court may require as a condition of release on bail the suspension of11
the driver's license of any person who is charged with a violation of vehicular12
homicide (R.S. 14:32.1).13
B.  The court shall notify the Department of Public Safety and Corrections,14
office of motor vehicles, of any order suspending the driver's license as provided for15

Abstract: Authorizes the court to suspend the driver's license of a person arrested for
vehicular homicide.
Present law provides for the crime of vehicular homicide.
Present law authorizes a court to establish conditions of bail for certain offenses.
Proposed law retains present law and provides that the court may require as a condition of
bail the suspension of a driver's license for a person arrested for vehicular homicide.
Proposed law requires the court to notify OMV of any such order.
