MTR VEHICLE/INSPECTION: Provides local option elections for the adjustment of motor
vehicle inspection fees in the nonattainment zone
AN ACT1
To amend and reenact R.S. 32:1306.1(C)(1), relative to motor vehicles inspections; to2
provide for charges for motor vehicle inspections in nonattainment parishes; to3
provide for local option elections in parishes in the nonattainment area; to provide4
relative to the conduct of such elections; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 32:1306.1(C)(1) is hereby amended and reenacted to read as follows:7
ยง1306.1. Inspection and maintenance program fees; nonattainment area; local8

C.(1) The parish governing authority may, by ordinance or resolution, call11
an election for the purpose of submitting to the qualified electors of the parish the12
question of whether the charge authorized by this Section will be assessed in that13
parish. Such election shall be held at the same time as the a statewide election14
scheduled for either October 2, 2010, or November 2, 2010. Any resolution calling15
the election authorized in this Section shall state whether the election will be held on16
October 2, 2010, or November 2, 2010 when the election will be held.17

Abstract: Authorizes parishes in the  nonattainment zone to call local option elections on
a statewide ballot to determine if an additional fee will be added to each motor
vehicle inspection that includes the performance of the I/M program. 
Present law provides for an annual charge of $10 for each certificate of inspection and
approval issued to a motor vehicle.  
Proposed law retains present law.
Present law provides that within the nonattainment zone (currently Ascension, East Baton
Rouge, Livingston, Iberville, and West  Baton Rouge parishes), an additional $8 shall be
charged for each inspection that includes the performance of the inspection and maintenance
(I/M) program.
Proposed law retains present law.
Present law provides that an additional $7 may be charged for each inspection that includes
the performance of the inspection and maintenance (I/M) program if the following occurs:
(1)The parish governing authority adopts a resolution or ordinance authorizing the
proposition of charging the fee authorized on the Oct. 2, 2010 or Nov. 2, 2010,
ballot.
(2)The majority of qualified elected voters approve the fee.
Proposed law retains present law and provides that the parish governing authority may adopt
a resolution or ordinance authorizing the proposition of charging the fee authorized on a
statewide ballot rather than the Oct. 2, 2010, or Nov. 2, 2010, ballot.
