TAX/TAX REBATES: (Constitutional Amendment) Adds tax rebates to La. taxpayers as
a purpose for which nonrecurring revenues may be appropriated
A JOINT RESOLUTION1
Proposing to enact Article VII, Section 10(D)(2)(g) of the Constitution of Louisiana, to2
authorize the payment of tax rebates to Louisiana taxpayers as a purpose for which3
nonrecurring revenues may be appropriated; authorizes the legislature to provide for4
implementation; to provide for submission of the proposed amendment to the5
electors; and to provide for related matters.6
Section 1. Be it resolved by the Legislature of Louisiana, two-thirds of the members7
elected to each house concurring, that there shall be submitted to the electors of the state of8
Louisiana, for their approval or rejection in the manner provided by law, a proposal to add9
Article VII, Section 10(D)(2)(g) of the Constitution of Louisiana, to read as follows:10

(2) Except as otherwise provided in this constitution, the appropriation or16
allocation of any money designated in the official forecast as nonrecurring shall be17
made only for the following purposes:18

(g) Providing for tax rebates to Louisiana residents who have paid Louisiana1
individual income tax, notwithstanding any other provision of this constitution to the2
contrary.  The legislature may provide by law for the implementation of this3
provision.4

Section 2. Be it further resolved that this proposed amendment shall be submitted6
to the electors of the state of Louisiana at the statewide election to be held on October 22,7
2011.8
Section 3. Be it further resolved that on the official ballot to be used at said election9
there shall be printed a proposition, upon which the electors of the state shall be permitted10
to vote FOR or AGAINST, to amend the Constitution of Louisiana, which proposition shall11
read as follows:12
To authorize the payment of tax rebates to Louisiana residents who have paid13
individual income tax as a purpose for which nonrecurring revenues may be14
appropriated. (Amends Article VII, Section 10(D)(2)(g))15

Abstract: Authorizes the appropriation of nonrecurring revenues for the payment of tax
rebates to La. residents who have paid income tax.
Present constitution restricts the appropriation of monies determined to be nonrecurring by
the Revenue Estimating Conference to the following purposes: 
(1)Retiring or for the defeasance of bonds in advance or in addition to the existing
amortization requirements of the state.
(2)Providing for payments against the unfunded accrued liability of the public
retirement systems which are in addition to any payments required for the annual
amortization of the unfunded accrued liability of the public retirement systems.
(3)Providing funding for capital outlay projects in the comprehensive state capital
budget.
(4)Providing for allocation or appropriation for deposit into the Budget Stabilization

(5)Providing for allocation or appropriation for deposit into the Coastal Protection and
Restoration Fund.
(6)Providing for new highway construction for which federal matching funds are
available, without excluding highway projects otherwise eligible as capital projects
under other provisions of this constitution.
Proposed constitution retains present constitution and adds the payment of tax rebates to La.
residents who have paid La. individual income tax as a purpose for which nonrecurring
revenues may be appropriated.
Provides for submission of the proposed amendment to the voters at the statewide election
to be held Oct. 22, 2011.
