ACT No. 97 Regular Session, 2011 HOUSE BILL NO. 299 BY REPRESENTATIVE CHAMPAGNE Prefiled pursuant to Article III, Section 2(A)(4)(b)(i) of the Constitution of Louisiana. AN ACT1 To enact R.S. 47:463.152 and 463.153, relative to motor vehicle special prestige license2 plates; to provide for the creation, issuance, and design of such license plates; to3 provide relative to the fee and distribution of fees for such plates; to authorize the4 promulgation of rules and regulations; and to provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 47:463.152 and 463.153 are hereby enacted to read as follows:7 §463.152. Special prestige license plate; "Louisiana Seafood"8 A. The secretary of the Department of Public Safety and Corrections shall9 establish a special prestige motor vehicle license plate to be known as the "Louisiana10 Seafood" plate, in support of the Louisiana seafood industry, provided there is a11 minimum of one thousand applicants for such plates. These license plates shall be12 restricted to use on passenger cars, pickup trucks, recreational vehicles, and vans.13 B. The color and design of the license plate shall be selected by the14 Louisiana Seafood Promotion and Marketing Board, provided that it is in compliance15 with R.S. 47:463(A)(3).16 C. The prestige license plate shall be issued, upon application, to any citizen17 of Louisiana in the same manner as any other motor vehicle license plate.18 D. The charge for the prestige license plate shall be the standard motor19 vehicle license tax imposed by Article VII, Section 5 of the Constitution of20 Louisiana, plus an annual royalty fee of twenty-five dollars for each license plate to21 be collected by the department every two years upon renewal of the plate, which22 shall be disbursed in accordance with Subsection E of this Section. The annual royalty fee shall be collected by the department and deposited3 into the Louisiana Seafood Promotion and Marketing Fund. The monies received4 from the royalty fees shall be used by the Louisiana Seafood Promotion and5 Marketing Board to implement the duties and functions of that board, relating to the6 promotion and marketing of seafood as provided for in R.S. 56:578.3.7 F. The secretary shall adopt rules and regulations as are necessary to8 implement the provisions of this Section.9 §463.153. Special prestige license plate; "Hospice"10 A. The secretary of the Department of Public Safety and Corrections shall11 establish a special prestige motor vehicle license plate to be known as the "Hospice"12 plate, provided there is a minimum of one thousand applicants for such plates. These13 license plates shall be restricted to use on passenger cars, pickup trucks, recreational14 vehicles, and vans.15 B. The color and design of the license plate shall be selected by the16 Louisiana Hospice Organization, provided that it is in compliance with R.S.17 47:463(A)(3).18 C. The prestige license plate shall be issued, upon application, to any citizen19 of Louisiana in the same manner as any other motor vehicle license plate.20 D. The charge for the prestige license plate shall be the standard motor21 vehicle license tax imposed by Article VII, Section 5 of the Constitution of22 Louisiana, plus an annual royalty fee of twenty-five dollars for each license plate to23 be collected by the department every two years upon renewal of the plate, which24 shall be disbursed in accordance with Subsection E of this Section.
