CONSUMERS/PROTECTI ON: Requires a merchant to request a form of photo
identification when a consumer is using a credit or debit card
AN ACT1
To enact R.S. 9:3518.4, relative to credit cards; to require a merchant to request a form of2
photo identification when a consumer is using a credit or debit card; to prohibit a3
merchant from recording information contained on the photo identification; and to4
provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 9:3518.4 is hereby enacted to read as follows:7
ยง3518.4. Credit or debit cards; photo identification required; recording information8
prohibited9
A merchant shall request a form of photo identification, including but not10
limited to a driver's license from the consumer in a transaction where a credit card11
or debit card is used as the form of payment.  The merchant is prohibited from12
recording the information contained on the photo identification unless the13
information is required to complete the transaction, such as for shipping purposes.14 HLS 11RS-927	ORIGINAL

Proposed law requires a merchant to request a form of photo identification, including but not
limited to a driver's license from the consumer in a transaction where a credit card or debit
card is used as the form of payment.
Proposed law prohibits the merchant from recording the information contained on the photo
identification unless the information is required to complete the transaction, such as for
shipping purposes.
