AN ACT1
To amend and reenact R.S. 17:3139(E), relative to audits of public postsecondary education2
institutions by the legislative auditor; to require audits of information submitted by3
such institutions to the Board of Regents as indication of achievement of4
performance objectives; to provide relative to the timing and costs of such audits;5
and to provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  R.S. 17:3139(E) is hereby amended and reenacted to read as follows: 8
ยง3139. Louisiana Granting Resources and Autonomy for Diplomas Act; purpose;9
agreements; monitoring and renewal; reporting10

E. Legislative auditor; performance analysis.  	Within six months after12
entering into a performance agreement pursuant to this Section, an institution shall13
provide to the legislative auditor all information that the auditor requests to conduct14
a detailed study of the performance of postsecondary education in Louisiana.  The15
institutions shall provide information that will allow the auditor to analyze how well16
goals and objectives of postsecondary education are being met and to perform an17
economy and efficiency study. Such information shall include but shall not be18
limited to information relative to staffing levels, hiring and compensation practices,19 ENROLLEDHB NO. 560

employee productivity and discipline, and performance management. This1
Subsection shall only be effective in the event that funds are appropriated to effect2
these provisions. The legislative auditor, in cooperation and coordination with the3
Board of Regents, shall annually audit data submitted or to be submitted by4
institutions to the Board of Regents as indicators of meeting performance objective5
targets established by or pursuant to this Section to ensure that the data is reliable.6
The auditor shall complete all audits pursuant to this Subsection and report his7
findings to the Board of Regents and to the legislature prior to the board's annual8
vote on whether an institution will be able to exercise tuition authority and9
operational autonomies pursuant to this Section. Each institution shall provide to the10
legislative auditor all of the information that the auditor requests to conduct audits11
pursuant to this Subsection.  The legislative auditor shall charge the actual costs of12
such audits to the institution being audited; however, no institution shall be charged13
more than ten thousand dollars for such audits in any single fiscal year unless a14
higher amount is authorized by the Legislative Audit Advisory Council. The council15
may authorize the auditor to charge an institution more than ten thousand dollars in16
a fiscal year if the additional actual costs are proven to be related to the scope of17
work described in this Subsection. No provision of this Subsection shall be18
construed to limit the authority of the auditor under any other provision of law. The19
legislative auditor shall, to the extent that he determines feasible and in the best20
interests of the state, take steps to minimize disruption of normal operations at the21
institutions such as conducting such audits in conjunction with the institution's22
financial audit.23

Section 2. This Act shall become effective upon signature by the governor or, if not25
signed by the governor, upon expiration of the time for bills to become law without signature26

vetoed by the governor and subsequently approved by the legislature, this Act shall become1
effective on the day following such approval.2
