SANITARY CODE: Suspends rules relative to the manufacturing and sale of cane syrup A CONCURRENT RESOLUTI ON1 To suspend until sixty days after final adjournment of the 2011 Regular Session of the2 Legislature the provisions of LAC 51:VI:103, 105, 109, and 151 and any other rules3 or regulations, promulgated pursuant to R.S. 40:4(A)(1)(a) as such provisions pertain4 to the manufacturing, processing, packing, holding, and sale of cane syrup made by5 traditional cane syrup makers.6 WHEREAS, certain parish health officers have interpreted provisions of the7 administrative code relative to permits for the manufacturing, processing, packing, or8 holding of food within the state and other provisions promulgated by the Department in9 pursuant to R.S. 40:4(A)(1)(a) as prohibiting the processing and sale of cane syrup by syrup10 makers who do not have a permit or an approved structure for production of the syrup; and11 WHEREAS, such interpretation prohibits the traditional cane syrup makers, both12 sorghum and sugarcane, from producing syrup in open facilities and in cast iron kettles or13 evaporators; and14 WHEREAS, parish health officers for certain parishes have enforced this15 interpretation in a manner that forces traditional cane syrup makers to either stop production16 or incur the unnecessary and significant expense associated with the conversion of traditional17 open sided facilities to modern state of the art facilities.18 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana hereby suspends19 the provisions of LAC 51:VI:103, 105, 109 and 151 and any other rules or regulations,20 HCR NO. 2 HLS 11RS-556 ORIGINAL Page 2 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. promulgated pursuant to R.S. 40:4(A)(1)(a) as such provisions pertain to the manufacturing,1 processing, packing, holding, and sale of cane syrup made by traditional cane syrup makers.2 BE IT FURTHER RESOLVED that this suspension shall become effective upon the3 adoption of this Resolution and shall extend through the sixtieth day after final adjournment4 of the 2011 Regular Session of the Legislature of Louisiana.5 DIGEST The digest printed below was prepared by House Legislative Services.
