Regular Session, 2011 ENROLLED SENATE BILL NO. 100 BY SENATORS MURRAY, HEITMEIER, MORRELL AND WILLARD-LEWIS AND REPRESENTATIVES ARNOLD, AUSTIN BADON, BISHOP, BROSSETT, HENDERSON, LEGER, MORENO AND STI AES AN ACT1 To amend and reenact R.S. 38:2295(C), relative to letting of public contracts; to provide for2 plans and specifications; to increase the number of working days prior to the opening3 of bids within which a potential supplier must submit a request for approval of a4 product other than that specified in the contract documents for public works projects5 of the New Orleans Sewerage and Water Board; and to provide for related matters.6 Notice of intention to introduce this Act has been published.7 Be it enacted by the Legislature of Louisiana:8 Section 1. R.S. 38:2295(C) is hereby amended and reenacted to read as follows: 9 ยง2295. Plans and specifications; required provisions10 * * *11 C. (1) If a potential supplier wishes to submit for prior approval a particular12 product other than a product specified in the contract documents, he shall do so no13 later than seven working days prior to the opening of bids. Within three days,14 exclusive of holidays and weekends, after such submission, the prime design15 professional shall furnish to both the public entity and the potential supplier written16 approval or denial of the product submitted.17 (2) Notwithstanding Paragraph (1) of this Subsection, for public works18 of the New Orleans Sewerage and Water Board, if a potential supplier wishes19 to submit for prior approval a particular product other than a product specified20 in the contract documents, he shall do so no later than fourteen working days21 prior to the opening of bids. This Act shall become effective upon signature by the governor or, if not1 signed by the governor, upon expiration of the time for bills to become law without signature2 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.
